Hypothetical question - IV petition pending, DV winner

Hi all,

I currently have a IV petition pending (likely to be adjudicated in 3-4 months) that is employer sponsored. Say for example I win DV 2015, with a low number, could I proceed with that over proceeding to file I-485 upon IV petition approval? The reason why I ask, is that it just feels cleaner to have my own sponsorship, that is all.

Just curious if anyone's had that scenario?

Our case was different, family petition with much longer wait time (like, another 6 years to get current) so that was pretty much a no-brainer for us. Generally I would say go for DV because as you say it's cleaner, not subject to conditions or someone suddenly being unable to sponsor you etc. However, in your case, if you will be able to do AOS in a few months anyway I can't really see what the benefit of waiting is...
 
Agree with Susie and add that the timeline for DV may be way after your IV process. The earliest numbers for DV2015 will start processing in October.
 
I'm just making sure that you understand the priority date. Unless you're EB1 or non india/china EB2, you would still have to wait until your priority date becomes current before you can do AOS.
