Hi,

Recently I have become a US citizen and I'd like to sponsor my husband (Canadian) to get a greencard.

Would you kindly explain what process exactly I should go through? I'm preparing I-130 now. What is after that?

Also, I'd like to know how long it takes to get petition approval.

congratulations on ur citizenship.

Is your husband in the United States right now??

If he is you can send the I130 / I485 ( and all the associated papers like

1. I765 Employment authorization card (work permit)
2. I693 (Immigration Medical Exam)
3. I131 (advanced parole if he wants to leave the US with his application pending)
4. G325A (2 forms 1 filed by you and 1 by your husband)
5. INS regulated pictures along with the necessary fees to your local district office.

I am not sure on the counsellar visa processing process but I can do some research and let you know.

OK. here is the situation.
I live near Canada, so my husband can commute anytime he wants as a visitor (Canadians don't need a visa).

While he is in the States as a visitor, can I still file I-130 and I-485 at the same time in a local office?

Jennie,

You cannot file for an I130 & I485 with your husband present in the US on a visitors visa (it would be considered visa fraud)

you can file the I130 with your service center and when its approved you can send the papers to the US Embassy in Canada for counsellar processing.

I'm sorry, I think I have confused you.
Actually, my husband doesn't have a visa (Canadians don't need a visa), but he can commute without restriction.

Is this the same case?

Hi Jennie,

Even if that is the case I am not sure if you can file his adjustment of status papers (entering the US on a visa waiver with an intent to change status is still considered a visa fraud.)
