Husband out of work, interview soon

Dear everyone!

My interview is coming soon in March. We are well prepared with lots of evidence (thanks for this forum) but another problem arose and I am so scared.
My husband contract after 6 years was completed at the end of 2005 and he doesn’t have a new job yet. He was working without a gap for the last 15 years, we have all the paystubs and last years tax returns. We are ready with the 2005 tax return, filling jointly. His income was always pretty high above the poverty line.
I hope and pray for us to find a new job before March 9th but obviously I am concerned , so please give me any advice regarding my case.

1. If he gets a job in February, it will be any problem that we can’t show up paystubs for the last two months? Just a month, or 2-3 weeks?
2. What will happen if he couldn’t find a job before the interview?
3. Is anybody there who wasn’t ask for paystubs during the interview?

Please help me.I highly appreciate your help.

He could get a letter from his employer stating his salary, join date etc. This should be enough to satisfy the immigraion officer.

2. What will happen if he couldn’t find a job before the interview?
Be ready with a joint sponsor
3. Is anybody there who wasn’t ask for paystubs during the interview?

Change of address?

My husband will start a new job in another state from 2o February(SC) My interview will be at 9th March. We don't want to relocate, this will be a temporary job till he gets something in our area.

My question are:

1. Do we need to send a change of address to USCIS?

2. My parents-in-law are in visit from abroad, till 2oth March, I must take care of them....Is it a problem, not to be with my husband 3 weeks prior the interview?

From the manual and memos released, the most import thing they consider for the income is current income. But if he has a job offer or had only worked a few weeks at the new job before the interview, I don't think you will have a problem. But they officer had a lot of discretion so be prepared just in case.

I saw on the uscis.gov web site:
http://uscis.gov/graphics/publicaffairs/USCISToday_Feb_06.pdf that an AR-11 is not mandatory while just applying, but is after your application is approved. So I would think if the move is temporary and you can still receive mail at your other address you don't need to file. But who really knows :)

I doubt a 3 week separation from your husband due to family reasons will cause any problems. As long as you are not separated because of marital problems, it will be fine.

The job is not temporary but we will consider like temporary one, waiting for the very first possibility to come back in FL.

For the beginning, maybe 3 weeks he will stay in a motel. There is no way to send any address change to USCIS as long as we didn't rent something, right?

BTW, there are two forms for address change: I-865 for a sponsor US citizen and the AR-11 for an alien, like me. Should we fill both of them?

Yes, you must keep your address updated and also the person who signed the 864 has to keep his address updated by filling out form 865 within 30 days.

I would say, if you are moving, complete an AR-11, even if it is temporary since there is a section of the AR-11 dealing with temporary moves.

She mentioned above that they are not moving to another state (not yet). They have a residence in Florida, a residence where they receive their mail and pay their bills and where RareGold will stay up until her interview.
I don’t think they should file for address change, especially where there is no any other valid addresses yet.
Even according to the link you provided, they shouldn’t, unless they decide to actually sell their house and move to another state together for good, forward their mail, disconnect their utilities and take all their staff with them.

I second Jane on this.

If a new address is not being registered in a different place, it could be treated as a vacation and you dont have to send an AR-11 or I-865 everytime you go for a vacation ;)

In my opinion, as long as applicant or petitioner reside at the address mentioned in the AOS application, and is their current mailing address, and both are reachable at that address at any point of time, i dont see the need to file AR-11 and I-865. My 2 cents...

We won't make any address change at this time and if we will be asked about the different place of working (visible from the employer letter) we can honestly say the truth: he is working from less than 3 weeks in SC, living in a hotel.......
He will come home (FL) every weekend because of his parents.

Do you think necessary to bring with me copies of my parents-in-law passports, I-94 or airtickets (back flight 20th March) as evidence they are really with us from 2 months?
