Husband jailed

I have my 2 yr gc, but the problem now is my husband has been jailed for 5 yrs for burglary, he became very depressed and heart broken after been relieved of his job, and he did the unthinkable went and stole, even before that incident the problem in the house was unbearable due to the job loss and minimal income, to cut a long story short, after he was arrested i decided to go my seperate way, i haven't been in contact with him since he went to jail, and i went to see an immigration attorney to know what my options are as far as removing the gc conditions.

She said since i have already made up my mind to file a divorce, my chances are 50/50 with the immigration, now do i continue to stay married to someone that has descrated our home and made me a laughing stock amongst our friends and family. Now also bear in mind that at one time i had got an injuction against my husband after he almost strangled me, but due to my family mediation, the injuction was never served and i decided to let it go and forgave him. Please somebody help me know what is the best route to go as far as getting my paperwork straightened out. Do i have a chance if i go on my own? I'm at a crossroad, pls help.
 
I think an I-751 removal of conditions stands a good chance. Having your spouse incarcerated for several years was not something you planned on, and not something you need to tolerate.

Find a different attorney.
 
thanks realcanadian, but please what category will i be filing under as soon as i file for divorce and ready to file for removal of conditions.
