Huge mess with my I-130 ... PLEASE HELP ME!!!!!!!!!!

Hi guys, I'm almost at the end of my rope. My father petioned for me (he is a perm. resident of the US). the info for my I-130 petition is as follows:

Recived date: April, 9th 2001
Notice Date: April 16th 2001
Section: Unmarried child 21/older of permanent resident

I live in South Carolina and my file is at the Texas Center.

I know about the processing dates and that it takes a long time for them to get through it. I've talked to numerous immigration lawyers and like many people in this forum got differnet answers. I also talked to a South Carolina state senator who then passed my info on to Lindsy Graham (US Senator), who politely sent me a letter saying "Check processing dates on-line...... good luck and thanks!" :confused:

I got engaged last christmas to an amazing girl from Poland, and now are trying to figure out a way to get her here with me for good. She graduated in March and is applying for a J1 Visa now (for July) but what happens after 18 months? :(

Guys I'm 30 yrs old now and I hate having to put my parents in a position where I'm mooching off them ......I'm ready to get on with my life ... only I can't because of this HUGE MESS I'M IN.

IF ANYONE KNOWS ANYTHING ELSE I CAN DO PLEASE ADVISE ME.

I dont see a huge mess or you being at the end of your rope. You are in a situation where you are waiting for your PD to become current.

Can i ask what status you are currently in the US?

Your father is eligible (provided he meets the requirements) to apply for naturalization this year. If he becomes a USC, then he can have your case upgraded from F2B to a F1B. This means your PD would become current once the application is upgraded (Current date for F1B is Apr 2001) and you can file for I-485. If you get married before he can upgrade, then you slip down to F3B and the wait increases by couple of years more. If you want to be on your own, you should try to get a H1-B if you are eligible for it, this way, you can get your wife to be on H4. Or try to get an F-1 visa

As for my status in the US? Well that's where is gets difficult. I've lived here since 1984 when my father brought the whole family down from canada, Due to a huge mix up (immigration offices closing... and our papers getting lost in the transfer :eek: ) things didn't get straighten out for a long time.....
mean while my brother wins the GC Lottery (I was 17 at the time) and brings my parents in.... we were told that it's quicker for a father to bring in a son than a brother to bring in a brother (I don't know if this is true?) I went to school here, graduated from USC and am just sitting here for the OK to go a head and work. I got a social secruity number but it's not valid for work and I don't have a GC :(

The sad thing is that there are sooooo many people out there that pray on people (immigrants) like me and my family that don't know the laws and give you wrong info just to make a buck off you.

the only sound advice I've heard was from the people at the INS office down here : "Just sit put until your turn is up and don't leave the country"
 
Just out of curiosity, why didn't your dad apply for naturalization? Once he becomes a citizen, you can get your GC within months as your PD already became current (after your dad updates his petition from F2B to F1)... so I really don't see any problem here unless your dad doesn't wanna apply for naturalization.

My father dosen't have a problem becoming a USC, but we have been told it can take up to 7 years for that to happen (is this true?). And I can't sit around for that long.

how long have your father had his greencard?

Few key points:

1) if your father is a US Citizen, it will be faster for him to apply a green card for you.
2) if your father is a green card holder, it will take long time to get you a green card.
3) if your brother is going to apply a green card for you, it will even take much longer. The fact is, even if your brother was a US Citizen, it would take at least 10 yrs+ to apply a sibling of his for an immigrant visa.
4) it might take your father few months till few yrs to get a US citizenship. However, it depends if he gets into the name check issue; and also depends on the DO he is going to file to.

few suggestions:
1) get yourself a job and have a company to sponsor you H1B.
2) marry to a US Citizen (it might not work since you are in love with someone else)
3) get your father to file the US Citizenship application, and hope his process would go smooth and get his US Citizenship as soon as possible (but it is pretty much out of your control)
