02/24/2006: Sen. Arlen Specter's "Comprehensive Immigration Reform Act of 2006" Draft

AILA has obtained and summarized the draft of Senator Specter's draft of Comprehensive Immigration Reform Act of 2006, which will be introduced in the Senate Judiciary shortly (March 2, 2006). This is basically a Republican bill that put together various pending bills with some adjustments, such as the PACE Act, McCain-Kennedy bill, and other Comprehensive Immigration Reform bills. We are happy to report that when it comes to the employment-based immigration, this bill incorporates the following key elements:
Recapture of employment-based immigration visa numbers since FY 2001
Exempt from the employment-based numerical limitation of the spouses and children of the EB immigrants

Exempt from the employment-based numerical limitation for (1) the advanced degree holders in Science, Technology, Engineering, or Mathematics with 3 years of work experience in the major fields in the U.S., or (2) National Interest Waiver EB-2. (For comparison with other bills, please revisit our summary report on 08/18/2005 in the Breaking News Archive.
Increase of employment-based immigrant quota from 140,000 to 290,000 with the allocations in EB-1=15%, EB-2=15%, EB-3 Skilled Worker/Professional=35%, Other Worker (Unskilled)=Upto 30%, and EB-4 Investor Immigrant=5%.
Special green card eligibility for the U.S. Doctorate Degree holders under the new F-4 visa program in Mathematics, Engineering, Technology or Physical Sciences with full full-time employment
Increase of H-1B annual quota from 65,000 to 115,000 or a market-based increase beyond 115,000
H-1B cap exempt for those advanced degree holders in the fields of Science, Technology, Engineering or Mathematics (not limited to the U.S. degree holders)
New F-4 visa for those pursuing advanced degree program in Mathematics, Engineering, Technology or Physical Sciences with the accompanying benefits of "intending immigrant" in certain cases, special handling labor certification application for immigration, and for the doctoral degree holders in the U.S., green-card eligibility
OPT period change for all the F-1 students from the current 12 months to 24 months and off-campus employment opportunity unrelated to the filed of study on or off academic terms under certain conditions.
Unfortunately, the Senator dropped from S. 1932 the provision on availability of I-485 filings for employment-based immigrants during the period of retrogression. We urge the Senator to reinstate this provision in the final draft of his bill before it is introduced to the Senate Judiciary Committee. Community leaders, please urgently contact the Senator's office to urge him to reinstate this provision.

02/28/2006: Western State Governors to Support Comprehensive Immigration Reform

Report indicates that more and more state governors come forward to urge support of Comprehensive Immigration Reform. It appears that this is particularly noticeable in the western states. There has been Governors conference for the last few days and reportedly the Utah Governor Jon Huntsman Jr. and Arizona Governor Janet Napolitano asked Western governors to:
* Oppose blanket amnesty to all undocumented workers and support "appropriate sanctions" for those breaking the law.
* Urge Congress to avoid creating incentives for more illegal immigration by "creating unnecessary hurdles and lengthy delays" for those wishing to immigrate legally.
* Call for full funding for law enforcement and security along the southern U.S. border, enforcement using "cutting-edge" technology, better coordination with law enforcement agents and construction of a federal correctional facility to house illegal immigrants convicted in state courts as well as reimbursement to states for incarcerating illegal immigrants.
* Request full funding for processing employment-based visas; eliminating visa-request backlogs and increasing the number of visas to meet U.S. industry needs, especially in high-tech, bio-tech and seasonal-based industries.
 
It is nice to know that there is some hope at the end of the TUNNEL.

But i don't understand one thing, we have put lot of efforts to send letters and fax to senators and all THRU ISNAMERICA. Nothing happened so far.

What is going on?????????? No body gave any explonation about what happened to all those bills etc....

Is this going to be the same as before or????????
Anybody knows any info about these bills and how and when they will be effecvtive or it is just waste of time and energy?????
[I know it is a big process to pass the BILL]. Bush is going to be in INDIA and i don't see why our INDIAN leaders won't push for this????

Think about it for a sec .... why would INDIAN leaders push for the US to give more greencards ???
After all, if people get frustrated with the GC process, they would be more likely to go home to India/China/wherever they came from.

Those countries don't get any extra benefit from its citizens getting US GC. (indirect benefits do accrue - but those are not really tied down to getting GC).

Only we can help ourselves !

I see a big reason for this. Huge population. Indian and Chinese should immigrate to other countries whenever possible and desirable.

The biggest insentive for the Indian and Chinese government to support more immigration to US is the massive population explosion there.
I know at least in India that the Infrastructure is ready to crumble anytime.

There used to be a question of brain drain, but India produces more brains than needed. So that issue is no more there.

The NRI always bring back a lot of foreign money and investment. In a global economy of the future its always better.

The US gov't realizes keeping these highly educated professionals from China/Indian is strategic to keep their country's competitiveness, and you think India and Chinese governments are so stupid not to realize that?

Huge population is true for both China and Indian. But what matters most is the "quality" of the population - if 99.9% populations are highly educated professionals and/or with execeptional skills, this country will overtake the US as the top power in the world; if 99.9% populations are illiterate,..., i don't even want to mention that.

In terms of density of population, Japan is much higher than both China and Idian. I don't see Japanese gov't want to "export" their most talent professionals to the US to solve the over-crowded population issue, and population did NOT become a burden for their development, instead, it was a invaluable asset! Why?? Again, it was the "quality" of the population that matters most.

I do see your point though I don't completely agree. There are millions of talents in China/Indian who don't want to immigrate and they are many others who want to. Immigration won't cause talent shortage. Education is the key that makes higher quality people. Likewise, the lack of immigrant won't give you more talents either. People want to move around to live desirable life (better or worse). However, to nations with limited resource and big populations, immigration is not a bad a choice to lessen impact to the environment as economy grows.
