HRR Waiver for J1-Specialist: Eligible or Not

I am on J1-Specialist (maximum duration is 1 year only). I want to apply for a waiver since my employer is willing to sponsor my H1. However, the lawyers say that if you come on J1-Specialist category you won't be eligible for waiver at all. PLEASE don't ask me to refer to the FAQs. I already did and there isn't any coverage for this particular case. Can anyone PLEASE answer or direct me to a genuine source. THANKS a TON!
 
what is the basis for your HRR?

I have never heard of a particular category not eligible to apply for a waiver.
 
I'm not a medical guy. My specialization is Philosophy and Natural Language Processing. I am assuming that it's based on the list of specialities that are subjected to HRR. But again, if you see the list, almost every field is in there!
 
not really. You are assuming it's based on the skills list. How about actually looking at your DS-2019 and finding out whether you have HRR, and what it is based on?

For example, Russia doesn't have a skills list. However, sometimes the DS-2019 is marked "HRR based on skills list" for Russians. All they have to do is send a request for an advisory opinion to DOS, and get a "not subject to HRR" determination.
