How to withdraw my husband\'s 485 application?

I called my attorney today and requested him to withdraw my husband\'s I485 application who was beneficiary on my application. My husband got his CP approved last week and came to the US with his passport stamped. Since he was also added as a spouse on my application, it makes sense to remove his name from my application.

My attorney is saying if I request withdrawl for his application, it may impact my own application. I am in EB1 category (CSC) and did my FPing 3 weeks ago. So I am expecting 485 approval soon. Does anybody know that withdrawl of my spouse application would impact mine or the attorney is just trying to scare me for some reason. He said by withdrawing my husband\'s appliction, INS may start an inquiry on my case and my case will get delayed by years. Please any inputs would be helpful because I always thought that withdrawl is a piece of cake and that is why we had put my husband\'s name in my application also.

There is a FP notice for my husband, if he does not go, it should mean an abondonment of his 485 application. Would this be a better route than withdrawl?

If your husband doesn\'t show-up for fingerprint, that means the application is incomplete and still waiting for FP. Unless the application is complete you can not be approved, thats the common understanding I guess.

In my opinion, your lawyer is correct.
If he does not go for FP , the application will
be considered abandoned (according to FP notice.)
So I guess just ignore FP and wait.

Whose application would be considered incomplete - his or mine? I was told that since I have proceeded with my FPing, my processing would proceed. His won\'t till he goes for FP. Please suggest!

ALso has anybody heard that withdrawl could create problems?
