How to use AP

I am on H1b and did not apply for EAD. I want to go abroad by the end of this year. I have AP now. Can I just go based on my H-1 status? Any risk?

I believe you will have to bring the documents for an new H1B application.

Your H1B will not be valid any more if you leave this country (unless you go to Canada, Mexico, etc. for less than 30 days where you can keep your original status without surrender your I-94).

Without an H1B or and EAD, you will not be elligible to work any more.

Urgent Q on AP

Per my lawyer, I can use Ap to come back and maintain my "pending status " and use my H1B to work. Is that correct? I am kind of worried because I may not have time to apply for EAD now. The reason I did not apply was because i don\'t want to change job and my lawyer told me it is not necessary to apply EAD then. PLease! please advice based on your experience and knowledge. Thanks!!
 
H1B & AP

I just came back from my business trip to Asia.
I have both H1B Visa stamp on my passport (exp. on 11/26/01)
In addition,I also hve my 2 copies of AP on hand. I have heard that
if I use AP to return to the States, I have to go through the secondary INS check at the airport after I pass the US custom counter.....

I arrived at the LAX on 10/16/01 afternoon about 3:30pm. When it was my turn to the Custom, I greeting to the officer and "intentionally" asked him that I have both H1B visa stampl on my passport and AP from INS. Which one should I use? The office looked at my passport and my H1B visa, then check the AP. He said: "it\'s better to use your H1B. It will take you a lot of time to get out the airport if you use "that". "That" refer to AP. ........

Then, he stamp the arrival date on my I-94 and passport, and I were through....

This is my experience and I believe that the officer I met was "too" nice" to me. I have heard that many posts on this site regarding the problems when using AP to return to the State. But... I was ok using my H1B, and my H1B will expired in late November this year....

I suggest that you have all documents prepared before you leave the States. Notice of action from INS, AP, letter from your employer...... are necessary to carry with you when you re-enter the US.
