Hi

Does anyone know how to upgrade the case of I-130 for my brother by my mom. She filed for him when she was a PR. Now she is USC. How can she upgrade the case. He is unmarried, over 21

What's up Zeeman? Hope you are doing okay and had a happy thanksgiving. If your brother's I -130 has already been approved contact the National Visa Center they will tell you what form you need to complete send to them inorder to upgrade your bother's petition. However, if the I-130 has not been approved your mother has to send a copy of her Citizenship Certificate to the USCIS service center that has your brother's petition. Before mailing anything contact USCIS.
 
check the nvc website to see if his priorty date is current or not if it is then he can apply for adjustment of status 485,765,864 and all that good stuff all u need to do to upgrade is to write a letter asking them to upgrade ur petition and explain ur situation that ur mother is a usc now and dont forget to sent a copy of the citizenship certificate upgrade is not necessary but to be on the safe side u could do that or u could just go ahead and file for AOS and they will take care of it but if u do it it may save u some time, goodluck.
