How to succeed in the job advertising and recruitment? Help!!

Hi, I'm in 3rd year H1B now. My company just started PERM for me. However, the job requirment for the job is only "BA in accounting, 3 years minumum accounting working experience." So I'm very worried about the advertising and recruiting test, because many US workers also could meet that requirement. How should I do? Any experience on this issue? Thanks.

Well, there is nothing you can do about it. Your company has to entertain all the responses and evaluate them all. If some are qualified, they have to interview and document. If someone is qualified then they have to offer them the job. The applicant might not take the job because what your company is offering.

If someone does not meet the criteria they have to document.

You need to look at this the correct way. The purpose of the GC is to prove to the government that there are no available, able, or willing US workers for the position and that's why they are hiring you. If there ARE US workers who can fill the position, then as the other poster mentioned, the company must offer them the job. It is illegal to tailor a position to the alien's specific requirements, and if tailoring is determined to be occurring on a petition, the DOL & USCIS may deny the petition and take action against the company in future petitions including supervised recruitment and/or barring them for filing labor petitions. One other item that should be mentioned is that the alien is NOT permitted to be involved in the recruitment process, as it demonstrates a lack of good-faith efforts by the company to recruit US workers if you are involved.
