under what condition or category did you filed for I-485 ?
I want to understand you better because we might be in the same situation of overstaying for 4 years , but in my case i had a petition filed by my wife since april 30th 2001 which has been approved now and i filed i-485 after my priority date became current . I have to let you know if you had taken advantage of the LIFE ACT 2000 amendements you are entitle to adjust your status with no problem in The united states with the 245(i) provision by paying an extra 1000 dolars on your i-485 aplication or i-485A . But if instead you married a US citizen and were admited with inspection in the USA you do not need to worry about extra fees . Since your have already filed the i-485 , you are in legal status till a decision on your case and you are eligible to receive the proper documents ( work permit ,social security # , advance parole )
Be ware : Since you have been ovestayed for 4 years filing an advance parole would not be a great idea . You would not be readmited in the united states for a bar periode of 10 years because you overstayed more than 180 days of your i-94 . Did you filed for employment autorization ( form i-765 ) it is alweays a great idea to do so while you are awaiting a decision on the I-485 .
