How to renew EAP/AP - if being layed off ??

I have read several posts that people get layed off - after 140 approval and 485 pending > 180 days. Not all of the employers provide the I-140 details.

Suppose - the employer says that they will not revoke i-140, but will not give copies of i-140 /nor reference numbers of 140 ,,,

1) Do we need the i-140 copies for any reason (approval, filing docs)

2) Do we need them to renew EAD/AP. (paper /e-file)

3) Any other reason ( beyond normal thinking)

4) Does one need valid EAD while entering USA - even if the AP is still valid ?

Gurus - please help

If 485 is pending > 180 days and you get laid of, you can use ACT21 to get another employer, you don't need the 140 copy. You will need to inform USCIS about using ACT21 though.

2) Do we need them to renew EAD/AP. (paper /e-file)
No, see the docs required for EAD/AP filing in the AP/EAD forum (http://immigrationportal.com/forumdisplay.php?f=31). Paper filing is recommended and is faster, with e-file, you will still need to make a trip tp the local ASC for fingerprinting, and photos.

Don't worry...:)

4) Does one need valid EAD while entering USA - even if the AP is still valid ?
AP should be good enough, but a valid EAD helps, but what do I know about this, I am just a moderator :) Check with your lawyer.

attroney to attorney comm - for i-140 docs request??

Based on the links joyd pointed, and after some reading here and there,

it looks like some service centers expect / need i-140 recept nos, recpt copy, / approval copy- for EAD/Ap renewal.

I have initialed FOIA in Jan 2005. Not sure when i would get it.

Planning to hire a attorney. What are the chances that if my new attorney request the existing one, for all docs, that he will get without any problems?

Also, if that happens, my employer may become pre-emptive and mess with me OR my GC process.Any way to avoid these?

I plan to get the docs and then search for a employer & then file AC-21?

pls advice

Get the copy of 140 using Freedom of Information Act.

It would take about 8 - 12 weeks but you would have 140 copy with you..in case you need it later for any reason.

You can get copy of LC also at the same time.
