How can someone prove that he didn't terminate his/her employment in US, during trip less then 6 months - if he/she is self-employed?!

Disruption of continuity of residence

"The types of documentation which may establish that the applicant did not disrupt the continuity of his or her residence in the United States during an extended absence include, but are not limited to, evidence that during the absence:

(A) The applicant did not terminate his or her employment in the United States;
(B) The applicant's immediate family remained in the United States;
(C) The applicant retained full access to his or her United States abode; or
(D) The applicant did not obtain employment while abroad."

Well - the first thing that comes to mind are:
1) Proving income was still coming in while you were out of the country. Some business have residual income and documenting that would certainly prove your business was still 'up and running'.
2) Providing utility bills for the business. If this is a home-based business, do you deduct certain expenses as business expenses? Do you have a separate business phone/fax line?
3) Did you file taxes based on your business for that year? If so, the tax returns and fact that you paid both personal and employer medicare/social security taxes on income is great proof.
4) Also the fact that you filed taxes shows that you consider yourself a resident of the USA.
5) Is your business registered on an annual basis? Do you have to pay fees per anum to state and local authorities? If so, these renewals can be used to prove the business was active throughout the year.

Hope these gave you some ideas.

On a single trip of less than 6 months its really not going to be a problem, and I'd be surprised if you get any difficult questions in that area. If you have multiple long trips, you may have a more difficult problem.
