How to obtain a green card

Ok here's the deal.
I got my asylee status through my mom abt 3 years ago. I was 19 at that time the asylum was granted. I've been reading throught the form to apply for green card and they said that I have to file another assylum form since I'm above 21 now..Here's what they say..

'If you were granted derivative asylee status as the child of an asylee and you are now over age 21 and are unmarried, you should contact the nearest asylum office and request information on filing a "nunc pro tunc" asylum application (using Form I-589). You may apply for adjustment of status after you have been physically present in the United States for a period of one year after the date you were granted asylum status.'

So have anyone of u fallen into that category. How's the process like when I fill assylum again through nunc pro tunc.Will it be the same like what my mom did? does it take as long as that?... I need advice since this is the only think that hold me back...

First of all, take it easy. My son is exactly like you. He got G/C already. Please use your mom's lawyer to handle it. It is no difficulities at all.
 
The law changed in 2002 and you probably do not need to do anything (though I cannot be sure without knowing the relevant dates).

Well so how do u process ur son's GC??

You probably do not have to.

If you care to provide the dates you filed for various applications I can tell you for sure.

Dear Blacksheep:

Talk with your mom's lawyer, just fill up a form, that is it. so easy. You no need to apply Asylum. Actually you are already Asylee. Relax.
 
If a primary asylee was granted asylum after 2002 when the person was under 21 does he or she needs to go through "nunc pro tunc" procedure?
 
My two cents: I think if you have already submitted your greencard application and you turned 21 while your case is pending, you don't have to do anything...but if you turned over 21 and you have not filed greencard application, then you need to do the nunc pro tunc...it is easy procedure and you don't have consult a lawyer. Just fill out the asylum application and turned in. It takes about 3 to 6 months.

Things you need to know about nunc pro tunc. while filing the application if you claim that you have depends, for example, you will not be eligible nunc pro tunc. Your application will be considered as a new asylum application and may be approved or denied, but if there is no change to your situation, they always approve nunc pro tunc to the date of your original grant of asylum. if your nunc pro tunc is approved and you get asylum through that process you can't cliam dependents-wife and children- in the future.

any case the nunc tunc pro process is not that bad...you get to be proactive.......good luck

The thing is I haven't submit my green card application yet, and I'm now over 21.What do you mean by 'if you claim that you have depends?' IS it like if I have a kid or something?

So how's the process like? Just submit the form along with my GC application and wait for 3-6 mos?

I haven't filed the application for GC. I was going to..that's why I'm asking all these questions :)

The two processes are completely different. You would need to file them separately. What you need is to first know if you are required to do it. I have the feeling that you will need to do the nunc pro tunc. If that is the case, then you will need to submit an asylum application. This will take about six months. Also, you can file your greencard application, and then wait. The USCIS will ask you to do the nunc pro tunc once your application comes up for adjudication. This will delay your case. It is good idea to do the nunc pro tunc now.

Bottom line: apply for your greencard first. this is very important because each day counts. then think about whether you wanna file nunc pro tunc or you wanna wait for the uscis to ask for the it.....

then it is very different from my son's case. my son applied G/C in 2000. Please consult with your lawyer.

I 'll probably just go ahead and file for nunc pro tunc and when I got it,I will file for the green card. What kind of documents do I need to send beside the one stated in the assylum applications?
