In May 2005, company A applied for my 140/485 based on substitute labor. 140 has been approved. 485 is pending. Working in company B. Never worked for company A. H1 is expiring in September 2005 and will complete my 6 years. What options i have to maintain my status in US after September 2005, if 485 is still pending at that time?

1. Can company B apply for 7th year extension based on substitute labor (140 is already approved).

2. Can i use EAD to work for company B (even it won't be 180 days on 485 in September).

3. What other measures can i take to maintain my legal status?

Thanks

----------------------- if I-485 is pending your status is AOS and H1 til Sep,2005, better file 7th year H1 extension based on pending I-485

------------------------ yes, just give the I-485 filing reciept and let the lawyer file 7th year H1 extension
2. Can i use EAD to work for company B (even it won't be 180 days on 485 in September).
---------------- you CAN use EAD, but if I am in your situation I will file for 7th year H1 extension as good back up plan
3. What other measures can i take to maintain my legal status?

Ginnu, correct me if I am wrong.

Since his I40 is approved for different company, he should need to use AC21 right?

------------- his I-485 is filed in MAY2005 at this time he is NOT eligible to use AC21, once his I-485 pending hits 180 days he should use AC21
