How to interpret Trump's tweet

#45: "In light of the attack from the Invisible Enemy, as well as the need to protect the jobs of our GREAT American Citizens, I will be signing an Executive Order to temporarily suspend immigration into the United States!".

I wonder if that will affect non-immigrant status and visas. I was hoping for an announcement easing restrictions on those non-immigrants already in the US, but no cigar. Looking forward the next election.

Do I-129 mail-in while possible... 240 days for USCIS to review and make a decision, while you can stay. They might need longer at this rate. If they deny later (well into the future), you can leave and try to apply at POE with care.

So your 6 month until expiry period begins in mid-July? You said renew soon.
If you're within 6 months until expiry, you can mail now and have status renew appropriately (if approved) and stay until a decision is reached.
No guarantee if it will be approved, but it will take USCIS a long time to process.

I am sorry that I mis presented ‘soon’. My TN will expire on Jan 8, 2020. I am preparing all the documents and plan to mail in July. Then I learned this news this evening and started to worry.

You mean, Jan 8, 2021. The immigration ban should be temporary and Supreme Court Judges can overturn any legislation that #45 tries to pass. And by then, we'll also likely have another President installed. You could mail the form with tracking much later if you really wanted to and hope nothing else crazy happens between now and then. Or if it's better/safe to visit a POE, then you could do that 2-3 weeks before expiry.

If your TN doesn't expire for another 8 months, I wouldn't even be visiting this site, Stay calm!!

Our TN and TD expire in July so was actually prepping to file I-129 and I-539 this past week with my employer. We are hoping to apply this week. The tweet is a little nerve wrecking but difficult to interpret. I'm taking solace in the fact the TN is a non-immigrant visa and hoping he is referring to folks who are not here in the US already.......but who knows?!

I think instead of panicking people should just wait and see what the executive order will say. In his tweet he said immigration into the US and I doubt that will affect people already in the US but we will have to see. Also I think he is just being his usual self seeking attention. considering immigration to the US is virtually at a halt now, as overseas consular services were already temporarily suspended.

Hi all,

I'm on F1 OPT STEM Extension that expires end of July. My company was likely going to extend me one year due to the project we are currently working on not being finished due to Covid. I was planning to get a temporary TN Visa for that year as I would really like to be on that project. With Trump's tweet last night planning to suspend immigration, does this mean I'm out of luck? I was planning to return and apply for TN at the border by plane. What are my options? Can the F1 be extended even though I'm in the OPT phase using I-539?

Regards,
A stressed out worker.

No one knows for sure until the EO is actually signed and the text is available. Until then, everything is purely speculative

Fair enough, thanks for the reply. Either way, curious about i-539 form being used to extend OPT? Does anyone have any experience with this?
