how to get IEAD if 90 days have not passed

question about EAD/IEAD

If you can not get an iEAD before 90 days, can you just take an unpaid leave or you must be laid off????

Realistically, unpaid leave of absence is best if it comes to that. But I think it's better to get a letter stating termination with the understanding that if you don't get your iEAD, you will just go on leave of absence.

Yes, I do have infopass appointment i.e. tomorrow. 03/16/2005. You haven't answered my question. Whether I can work on 04/06/2005 or not !!!

I requested and got a letter from my employer about terminating if I couldn't get EAD by 04/06/2005. They mentioned my job role and when do I joined blah blah blah.

My other concern here is I applied all my GC process through A and I quit once I get my 140 and first EAD. Now I am with company B. I didn't file AC-21. Now I got letter from B. Working with B since 8 months. Is it going to be any problem if I show the letter to immigration officer !!!

I called the 1-800 number and used the tip to reach to the VSC rep and when I enquired about my EAD status and explained her the situation, she asked me choose correct options and talk to NCSC rep instead of VSC. There is only one 800 Number to reach VSC or NCSC. Hope this clears your confusion.

When I said "safe bet" I meant that you can work until and including the EAD expiry date.
I did almost the same thing as you except that I was forced out of my company A well before the 140 approval. I used a company B letter. The officer I dealt with didn't care at all who I was employed with, just as long as it looked like a ligitimate company (letterhead, dated, signature, etc.) I was thinking like you and brought an AC21 letter just in case but it didn't matter. Since then I've moved to a company C so that original AC21 letter would have just taken up precious space in my file :) I was and am still a little concerned about having that letter in my file but it saved my butt and allowed me to feed my family.

By bring all documents I gone to local immigration office today about my chances of getting IEAD before 90days. The officer said I need to wait until 90 days and there is no way I can get a temporary or I-EAD before 90 days . So, my chances are faded and I need to wait until 90 days.

Any advises here !!!

Sorry to hear that. It's possible that they are operating under different internal guidelines than other district offices. You could always try again another day and hope to get a different response. The officer you talked to, was he/she the desk officer or the "appointment time check" officer? Here we have a first officer that checks appointment times and issues a queue number. Then when your number is called you talk to the actual desk officer. The reason I ask is that I've heard some people get turned away by security or the appointment person before they even get to the desk officer. If that's not the case for you then like I said earlier, you can always go try again. If that still fails just ask your company to put you on temporary leave of absence until you get to 90days.
