How to find out if your visa was counted under cap?

If you are working for an institution that is exempt from the cap, does it automatically mean that your visa has not been counted under the cap? Should the lawyer specifically ask for the visa application to be exempt from the cap while filing or will the INS do it anyway?

Yes.

I believe there is a supplement to form I-129 for exempt institutions that is filed along with the petition.

It would have been pretty easy last year.

If you paid 11xx you would be included in the cap (non-renewals).

If you paid 1xx then not.
