How to demonstrate labor certification shoud be waived for NIW?

This is probably the most difficult question for NIW. How can we persuasively demonstrate that "the national interest would be adversely affected if a labor certification were required for the alien." Any comments? especially those successful applicants. Thanks a lot!

I had a lawer too,

but I need to make draft for her. She gave me some template, but it looks very simple. So far she had only corrected a couple of grammar problems. I did not trust her and decided to submit application by myself, although I have paid her one thousand $... I have got a lot of help here. Thanks.

Since LC requires one to look for other suitable qualified individuals,

you may write about your skills that are more than the average scientist and thus it would be more adverse for the institution to waste time/money to look for someone else rather than hiring you who is already there. I have an MD and also a graduate degree in Biological sciences..so it helped to talk about the combination. Plus you may have prizes from american society or graduate/medical school which denotes substantial recognition of skills.

Lawyer

I\'m sorry to hear that you got screwed over by your lawyer. I hope you at least got some useful information from her. Anytime I\'ve needed a lawyer (immigration, real estate), I\'ve always gotten a reference first. There are too many hacks out there.

You\'re really going to have to be careful to make sure your petition meets the legal requirements of a NIW. A lot of attorneys believe that a NIW is more difficult than an EB-1 EA. The key is in the letters. You seem to be quite far along in the process. The strategy should be to determine what it is you want to prove and pick your referees to point in that direction (a bit like the scientific method, eh?). Trying to write a cover letter and figure out what you want to say after the letters have come in is kind of ass-backwards. Good luck. Brian.

Thanks a lot, leroythelion and ag28

Thanks a lot, leroythelion and ag28. Your suggestions are very helpful. It seems to me the key to make this point is to let some well know person to testify that your contribution is way above the US worker having the same minimum qualifications. I consulted other lawyers. They said this should be enough. Do you think there is other means to argue this? Lastly, as leroythelion said, we should be careful when we hire a lawyer.
