How to delay FP?

My company is filling I-485 at end of may 07, and i have plans to get married in July 07, during june-july 07 i will in india. here is my question
1) If FP come when i'm on vacation, can my lawyer postpone it for two month?
2) Can i add my wife after my FP?
3) Should i apply after comming from vacation?

Appreciate advice?:)
 
It is much more advisable, for all the obvious reasons, to wait until you come back with your bride and then apply for I-485 together. Since you are newly married, please be sure to bring enough evidence that the marriage is genuine, especially as you will not have had joint tax returns or anything, so a wedding invitation and pictures of the wedding might be useful to include in your I-485 application, along with the marriage certificate of course.

I don't think it's easy to add a spouse to a pending I-485, and most would advise strongly against it (i.e. get married first). I assume you are on a valid H-1B, correct? Otherwise, it may be more complicated...

I was thinking if i apply now i would save some time, I-485 approval take around a year, but if too complicated i will wait?
 
It will be worth a 2 month delay to wait until you come back. It's better to apply together as husband and wife, and lose 2 months of time, than to apply alone and then have to deal with all the hassles of getting a green card for your wife, which as I understand is very difficult.

Think of it this way: If you apply in May, and she comes back in July, and until you figure out how to apply for her it's already September, then you will get your green card in May 2008 but she will get hers in Sept. 2008. If you apply together as soon as you get back in July, you both will receive the green card together in July 2008, BEFORE September 2008.

I recommend you also post this question on the H visa forum, there will be a lot of people there who have been in similar situations and will tell you how easy or difficult it is to add a spouse after the application has been submitted.

You can add your wife any time while your I-485 is pending and suppose she is in status in US, she can even apply for her I-485 after yours get approved. just go ahead and apply for yourself. I applied and received my FP notice and did Fp and after that my wife applied with no problem (see my signature).
