I used to work for a Software company in India and they applied for my H1 also. I traveled to US for some project from jun 2007 till sept 2007 and then resigned from this company in Dec 2007 as i got married and then came to US in jan 2008 on H4.
I consulted one consultant in US and filed for my H1 transfer in Oct 2007. This consultant has given me the receipt# and the online status of my H1 transfer shows USCIS has requested for some education evidence which he has not provided till yet. Now this consultant is not responding to any of my queries. I want to work in US as i hold a valid Masters degree (from India) but can not, as i'm on H4 and my H1 transfer process is not yet complete.My H1 is valid till Sept 2009.
My questions are:
1) How should i pressurize the consultant who filed the H1 transfer petition . Moreover this consultant has taken the full fees of transfer ($3000) and has not given us any fees receipt. Can i reply to USCIS directly or can any other consulting firm work on this transfer.
2) when the petition will expire? Will the expiration affect me in any way.
3) How can i change my status from H4 to H1 as i already possessed H1 before.
Your response will be appreciated as this problem is giving me sleepless nights.
