I got my H1B visa stamped 7 months after my the start of my I-797 start date. I also spent 4 months on my vacation in India. Can I claim this period on my H1-B renewal/extension.

My First I-797 was valid for two years after that I applied for renewal of my
I-797 which was valid for 3 more years (This renewed I-797 is expiring in 4 months). I have to file for a renewal, I have not yet filed for Green card labour certificate.

Can you please advice what are my options ? Can I claim the lost 11 months in the my newer renewal application ? Also can you advice how long is it taking now a days for the approval of I-797 extension ?

Your help greatly appreciated.

------ Count the 6 years from your date of First entry to US on H1B, if you spent time out of US after that you can recapture. you need to provide all the pages of passport that has stamps to US and when you depart for US from your home country and stamps from your home country when you entred then you need very good lawyer to point out to USCIS of these stapms and should write on cover letter. It all depends how your lawyer present the case and request for recapture, many have recaptured and many were denied, go to good lawyer.
Make a list with dates ofEntry to US and Exit from US and exit from your home country and attach passport pages with Stamps and provide to your lawyer with other documents
