How to apply for Emergency A Parole?

I have applied for EAD/AP renewal dated Aug 10th 2005 at VSC. Im working on H1 & its valid till 2007. WE want to travel to India between November to Dec 2005. WHen checked the status online ..seems its taking 150-180 days for AP approval. I know we can travel on H1/H4 ...but the attorney suggested we should still wait for AP as a backup.

Now, since we really need to make that visit in Nov ...& in case our regular AP renewal doesnt come thru by that date ..is there a way that we can apply for Emergency AP at our local INS office in San Jose? If so .. any idea how long that procedure takes & what docs are required for the same?
- And if we apply for emergency AP does it affect our regular AP/EAD process in any way ..& those get approved when wee are away?

Would appreciate your response, Gurus...

------------------ if you have valid Visa stamps when you come back why do you need AP? ask the lawyer why you need AP if you want to enter with H1 and H4 valid Visa stamps. if you have to get NEW visa stamps then only having valid AP is good back up

---Local office will need proof of any emergency

----------------- any proof of emergency like fax from hospital or doctor

----------- if AP gets approved while you are not in US you cant use that AP
