How to apply for a change of employer and job description?

Hi,

Thanks in advance for your advice! My current TN is valid through June 2007. I want to switch employers. My new employer would be a different job description as well (to Scientific Technician from Research Assistant). I have a couple questions:
1) If I apply by mail, would this be a "New Employment" or "Change of Employer" petition? (I-129 Part 2, Question 2)
2) If I go to a POE and apply for a new TN and get rejected, can I then choose to re-enter the U.S. on my original valid TN? (I have not yet quit) Is there any chance they will take that away from me and leave me stuck in Canada?
3) In either case, will it raise troubles that I am applying for a new full-time job? How do I explain that I only will quit my existing TN sponsor if I get approval with my new one?

there is no need for concerns regarding applying for the 2nd TN. There is also no need to tell any officials that you plan on quiting the first job. you are completely entitled to hold more than one TN at once. hence if one is expired or revoked, you can always use the other assuming it is still valid.

Simply go to the POE and apply for the new TN just as you did for the initial TN. the proceedure will be exactly the same. nothing to worry about. I would not do a mail in since it will take in excess of 5 months.
 
From some peoples experiences, you will most likely want to apply for the 2nd TN in person at the border rather then doing the mail in for it the first time. Reason is (and many have gotten into this problem) is it can take a long while getting it from the mail. You many have ended up having their 2nd job, finally giving up and hiring someone else as the TN hadn't arrrived anywhere near the official starting date the companies wanted. Not sure, but I don't know how far in advace you can apply for a TN by mail for a 2nd job either. If you do it 6 months ahead it may be rejected and told to send it closer to the date.

Anyways, it seems mail in for another TN for the first time can run into a lot of problems (especially if you quit your other job before getting the 2nd one). Best is to do it at the border, and many people get 2 TNs easily that way...

Believe it or not, if your a currently in TN status, then changing employers is actually an extension.
