How strict is the post graduation 5 year experience for EB-2 category?

I graduated Computer Science in June 2000, in january 2005 my company obtained an L-1 visa for me.

I was working for about a year before I finished college. Now in 2007 I want to file for permanent resident status and obviously would much prefer to file EB-2 rather than EB-3 because of the wait time.

Is it possible to claim the 5 years experience + B.A. if some of that experience overlaps with college graduation?

OR

Do I have enough experience (June 2000 to now [March 2007]) because I haven't yet filed for PERM/EB-2, I just have my L1-B visa?

Before you qulaify for EB2, first check, Do your Job offer/description meets EB2 creteria.

If you have a 4-year Bachelor's degree and your company is willing to do so (high salary, position requirements, your credentials, etc.), you can file an EB2 using the Mast + 1-3 (some firms use M+1, others use M+3, which is why I indicated it as such--we use M+1) or the alternative of a Bach + 5yrs. experience requirement. But, in most cases, the Computer Science bachelor is a 3 year degree, so you would not be eligible for this.
In order to file under EB2 using a master's credential, if you had a 3 year bachelor's degree, you would also have to have a 3 year master's degree. Even if you obtain an educational evaluation that gives you a master's degree, the USCIS will NOT (99.9% of the time ~ I have heard of one or two cases getting through, but don't count on it) accept the combination.
Hope this information is found valueable.
