That will be fraud!
If you or your employer has any intention of terminating employment (before getting the green card), and you still go for CP, that constitutes fraud.
That\'s what the law says.
If you ask me, if your employer can give you a notarized employment letter even after you getting laid off, take it and go to your home country (so that you have some explanation for not having latest pay checks).
