Guys,
I am this question has been asked/answered before. But could someone please tell me how much time (approx) take for GC though CP once I140 has been cleared. I am from VSC.

You have to focus differently after your file transfered from INS to NVC

Because it is taking any where between 2 weeks to 3 months for the file to be transfered to NVC from INS. This around 6 months is only if it is transfered in 2 weeks otherwise the delay will add up to that. Browse the discussion boards how this delay is affecting some persons.
Avearge from the day 140 approved:
1. 2 weeks file to reach NVC
2. 2 weeks to complete the agent of choice letter
3. 2 weeks to create case
4. 2 weeks to send packet 3
5. 2 weeks for file to reach NVC again from St. Louis
6. 4 weeks for review
7. 2 weeks for file to be sent to consualte
8. 8 weeks for interview date to get GC

You might save some time 2 to 4 weeks depends on the situation and your luck. But you ought to be prepared for 6 months. If you file for I-140 now then think about the visa numbers might retrogress in the next fiscal year.

Throughout CP is there any stage when I can be laid off and still continue with CP

am trying to figure out a stage (ie. how much time ) elapses before I am safe from the vagaries of layoff
Do I have to be employed throughout the process (and show salary slips until the last date)
My employer may be willing to keep me with no salary
Thanks

That will be fraud!

If you or your employer has any intention of terminating employment (before getting the green card), and you still go for CP, that constitutes fraud.

That\'s what the law says.

If you ask me, if your employer can give you a notarized employment letter even after you getting laid off, take it and go to your home country (so that you have some explanation for not having latest pay checks).

That\'s my idea. May be I am totally wrong.

No Title

if your employer can give you a notarized employment letter even after you getting laid off, take it and go to your home country

And in what way does that not constitute fraud ? Its all about intent on what will happen after you reenter the US.

As I said, it\'s fraud...

I didn\'t say that my opinion was NOT fraud. It is fraud (and no question about that). On the other hand, how many people have changed their jobs just after getting their GC. I am pretty sure that every one of us has the "intent" to change our jobs once we get our green cards (don\'t tell me you are going to be stuck with this job for ever). That is once again fraud (the intent to change job). So, all I was suggesting was that if he/she can get an employment letter and if the employer is co-operative, then why waste a chance of getting green card?

I was hoping for some portability provision as I485

Was hoping for something similar to this
Since CP and 485 both seem to take six months
it seems both are equivalent when it comes to choosing a safe method for layoff threatened applicants

Fraud: Well, I guess even the employers who layoff are guilty of fraud. Aren\'t they suppose to display an intent of employing workers after the green card is granted.
Workers anyway are commiting this by changing jobs if the intent is interpreted in the strictest possible sense.
Thanks for the help though

GC is for future job

If you laid off then What I think is GC is for future job then the employer letter would say that after you get your GC then you will be given the stated job. If you continue to be in US after you laid off then you have to be in status, then you must be on another company pay check (for you to be in staus) before you get GC and you go the consulate with the employment letter for future job.

If you can\'t find a job here then go to India so you are not violating law then take the employment letter for the future job and go for your interview.

Only the difference is in the employment letter how you mention like if you are currently in the same job (which is going to permanent employment) then it will say that. If you are not in the same job then it will say that.

That is it.
