I mean, How much time does a USC have to live in a county before a USC can apply for a marriage based petition?

Me and my fiance both live in same state but in different counties. And she will be moving in with me, so was wondering

1) Can she apply marriage based petition once we get married? or
2) Do we have to wait for some time in this county?

Answers appreciated

There is no waiting period after you become a US citizen. You must provide a copy of your naturalization certificate.

For further information check www.uscis.gov in the part of Family Base Petitions.

Good luck,

You can apply as soon as you get married.

Excuse me for not asking the question in the right way?

Excuse me for not asking the question in the right way?

My question is:-

1) Can she apply for me in my county(since she lives in different
county now) once we get married

OR

2) Does she have to live here for some months before
she can apply.

I am getting confuse here. You mean "County" or Country"??

it doesn't matter what counties you live in (unless the counties, well, actually the cities belong to different local districts - do look up the districts on www.uscis.gov). Apply after you get your marriage certificate, you can apply for her GC.

Do collect evidence of a real marriage for the interview.

Yes the Cities do belong to different districts.
She(USC) lives in Sacramento, CA and I live in San Francisco, CA and after marriage we are both trying to settle in San Jose, CA.

Where(Which Office) should we apply for?San Francisco, Sacramento or San Jose?

All forms for a family based GC should be sent to the chicago lock box. Like amishah said, you can apply for GC right away after you get married.

thanks for your reply. I got that I have to send the forms to Chicago lock box but since we will be moving to San Jose after marriage, where will be interviewed/called upon. That was my question.

Since I live in San Francisco and she(USC) lives in Sacramento and we will be moving to San Jose after marrigae where will be interviewed.

There was an earlier thread where we had this discussion on which DO to pick. Im still not sure of the answer as no one followed up after that.
