LUD on 02/04/05...Received RFE response

LUD on 02/07/05, 02/08/05, 02/09/05.....Reviewing the file...

No action for 11 days after last LUD...Our existing theory worked good (10-25 days for the approval)

LUD on 02/25/05.....APPROVAL...Thanks to GOD...Thanks to everyone for

First time poster.Is about my mother:
She got 485 denied because I140 was not approved or pending
Lawyer did motion to reopen ,was approved
Inquiery on I140
received letter stating that previous decision should remain valid(485 denied)because 140 was denied dec.7
Now,neither we or the lawyer got anything on this dec 7 140 denial.How is this posssible?
Lawyer suggested to do ANOTHER motion to reopen 485 since we have no proof of 140 denied 3 months ago
Is this the way you went?Because it looks like you got your 140 approved
Any help is more than welcome

Guys , LUD has changed on 2/17 th and it says they are asking for additional information does that mean RFE or NOID or deny ?

my Lawyer nor myself did not get any letter till now.

Please share any ideas as to how to proceed. To call INS or ask Lawyer to send letter to INS e.t.c...

Generally RFEs are updated on the online status. But anyway, it takes about 2 weeks for your attorney to receive the RFE details from the date of issue of RFE.

As LSaspirant suggested, your attorney could check by calling the customer service in their 1-800 number and finding out if there was a RFE issued.

I-140 approved after 2 LUD changes

I am really glad to say that my 140 got approved (on 2/18/05). Lawyer received the approval notice and faxed it to me (checked the approval notice a thousand times already to make sure everything is ok). No emails from the system - same old "...petition received message..."

LUD for my 140 changed on 2/18 and then again on 2/21 with no change in message. That had me concerned (if an RFE was on its way) but it looks like the officer working on my case just did not update the system right. It looks like this is what might have happened - LUD 1 on 2/18 - case was approved by the officer - LUD 2 on 2/21 - approval was printed and mailed.

LUDs on 2/22 and 2/23. Please comment on what's the chances of what's
happning here. Apparently, it takes only 7 days for approval, but some
of the recent guys seem to have been approved after even 2-3 weeks.
Do you think that the approval time is increased right now, or should
I expect my case to not go through. Please comment.

I replied to my RFE on 140 on 01/27 (they received it on 02/03), it is still not processed. No LUD change either. What does your status message say now? Does it say that they received the RFE reply?

For me, I had LUD on the next day after my lawyer sent the RFE reply (2/17).
Message changed to "We received your reply to RFE on 2/17.....". Then,
had LUDs on 2/22 and 2/23. Nothing after that.

Yes, Mine changed (140 & 485) 3 times after responding to RFE, again changed 2/3/05 then I got fp notices for me and my wife.

2003 EB2, Still waiting

I am waiting for getting response for replied RFE . It is been almost a one month since LUD. There is no chnage in the message. Where am i going for?
Is there any one who got positive response after this long time also.

My theory on the delays

Here is my theory on the current delays. My guess is that they have officers making the decisions, and then the mailing out of the notices, and other "official" book-keeping is done by the clerical staff. The clerical people are busy these days in sending out the fingerprint notices. Therefore, it appears that
the approval notices for everything else is delayed (I don't see many I-140s or
I-485s being approved right now). So, I am expecting something to happen in
2-3 weeks, not this week.

Hope my theory is right, otherwise all of us are in deep s*** (unlikely)!
 
Gurus please advice . My LUD finally changed for I-140/ 485 after RFE replied and recv on Oct 13th 2004. Got a FP notice recently. IS this moving somewhere ?? Please check signature and comment. Thanks
 
Waiting after LUD was changed

I submitted my I140 petition (NIW) to Vermont Center in December 2002. I have not received any response so far. The last updated date (LUD) for my I140 and 485 application was changed on February 1st, 2005. I guess a officer is currently reviewing my case. I understand staffs in Vermont Center are extemely busy at this moment. Can anybody tell me how soon I may expect to know their decision, no matter it is approval, ref or denial? Is anybody in the same situation as mine?

I'm not sure if I'm posting in the right thread.

I had LUD on 140 on 2/25 and on 3/08 LUD again changed saying they need more information. I guess it is RFE. Is it common to receive RFE or is there anything to be worried about. What are the usual RFE's one receives.

Yes it's an RFE. RFE are common and not worth getting concerned. The most common 140 RFEs are regarding (1) Ability to pay, (2) Education evaluation, and (3) Tax documents (W2 and Tax returns).

RFE and NOID are two different things and most often people confuse one with another. RFE is Requests for Evidence while NOID is Notices of Intent to Deny. Here are difference between an RFE and a NOID.
  • A RFE is more appropriate when a particular piece or pieces of necessary evidence are missing... [it should ideally] limit the request to the missing evidence.
  • A NOID is more appropriate than a RFE when initial evidence is predominantly present, but: the filing does not appear to establish eligibility by the preponderance of the evidence; the case appears to be ineligible for approval but not necessarily incurable; or the adjudicator intends to rely for denial on evidence not submitted by the filer.
  • It is possible to combine... a RFE and a NOID requesting additional evidence on some points and explaining anticipated basis for denial on others.

Thanks for the response. I guess in my case it should be W2 or ability to pay. I have another question regarding this. I do have W2 forms but not tax return forms. Is there any way I can get a copy of them from IRS.
