I'm US citizen and going to marry women next month in New York with B1 visa, she overstayed for two or three years. She's got two kids. Please let me know:
1. How long is going to take for her to get SS# and Working Authorization to be able work here legaly ?
2. What about kids ? is anything i need to do additional to get GC for kids or that aoutomatical process ?
3. And how much is the minimum of my incom should be for AFFIDAVIT OF SUPPORT ?

thanks a lot

no matter who is the USC and who`s on B1 .....

since you are going to marry USC and your B1 visa is expired for almost three years , it does`nt matter your overstayed visa would be forgotten because your USC spouse will file i-130 , i-485 & i-765 on your behalf and you would have another status the one of a (c)(9) ( pending I-485 ) it would qualify you for employment and stay in the united state legaly for adjustment of status . You would have to go for finger print and bio metric for your I-485(adjustment of status ) & I-765 ( employment authorization) then after 1 month or two you will receive the EAD card in the mail and from there you would go to have Social security issue you a conditional SSN ( usaualy takes two weeks from request )

one more thing : since you are actualy on a expired I-94 you can not leave the country till you adjust your status , failing to stay in that period would disqualify your application and you would trigger the 10 years penality bar of inadmissibility . that is mean stay way from AP (advance parole )

hope these infos help .....
