How long MTR takes to process

Hi guys,
My i485 got denied on 13th feb 2009 after 2 days of my interview.I was due to uscis mistake.i filled under 245i.Denial reason is they made a decision on my I140 ,ignoring that i filled my labour certification back in april 2001.I filed MTR and sent them copy of my approved labor certification.

I didnot get any receipt notice no update on online status.how long usually it takes.it been 9 long year and it ended up like this.anyone in same boat.

Being out of status shouldn't be grounds for denial of the I-140, 245i or not. What was the stated reason?

they did not look at my LC

they dont have any record when i filed the labour certification.its stated that cause your i140 was filed after 30th april 2001 thats y you technicaly dont qualify for 245i.i have certified labor that was filed on 30th april 2001.

mtr dismissed

my mtr is dismissed.when i filled for i140 my lc was swapped.and the labour certification of other person was also filed on 30th april 2001.they saying because that alien filed his labour certification on april 30th he can only be grandfathered under 245 i catagory.i sent them copy of my LC approved from labor department.They saying since its a copy they cant verify it with labour department,and we did not send em orignol.thats why i disqualify for 245i.What a shit is this.Can i refile MTR and send em originol LC.My lawer is saying we should refile i485,and get another interview and clear whole situation out.he dont want to send em origional.My question is can i file MTR again cause it was quick they made deciosion in less than 2 months.

Simply go to the Court. They need to get the copy of your Labor.
