recently got an email from fbi saying my name check has been completed (aug 28, 2004) and sent to NSC.

how long does it take to get approved after that?

i called congressman/senator's office for help. they told me they could not expedite the FBI chack. now that FBI check is done. can i call them to do more? what more can they do? my case is way behind NSC's processing date ...

rfe: 04/01/2003
2nd fp: 01/21/2004

So you are a 2001 filer, glad to know I'm not quite alone here. Except I never had a RFE.

I have no answer for you question. I'm still waiting on the FBI results.

I did the FBI inquiry about 3 weeks (same fax no.), and still waiting. I've notice something: for old-timers like us, processing of a single piece of data (address change, RFE etc) takes little over 30 days; and for people with RD Sep/Oct 02 it takes less than a week, or even 2 days.
Based on that, if FBI forwarded your data back to CIS then end of Sep is your date my friend.

Make sure you keep us posted.

thanks pal

i actually noticed, in my e-portfolio at uscis, that there was a so-called update on sept 14. the case status hasn't changed, though. maybe that update means someone at NSC finally opened my case.

my question was: do congressmen/senators have the power to ask NSC to observe their processing date for my case -- my case is now totally in NSC's hands. (congressmen/senators claim they cannot expedite FBI's check, but fortunately that part was finally done)

Could it be that LUD of Sep 14 was when they actually received the results from the name check, and put them in the file?

How long were you stuck in a FBI check? Also have made an inquiry to uscis?

From what I read around, congressmen/senators can not do much but a check on your case. Maybe this is coincidence but the cases I remember got approved shortly after senator's office contacted uscis. Maybe someone else here can shed some light on this.

sigh

i'm not sure what they did for the LUD.

i did get a voicemail from a senator's office that NSC has received the FBI clearance early this month. but that voicemail also suggested wait 4-6 more weeks ... it's very hard to get in touch with those staff members -- they never reply your voice message unless you're lucky that their phonelines are not busy.

you're right that congressmen/senators usually claim they can only file inquiries. but i don't want to wait another 4-6 weeks and then ask them to file another so-called inquiry.

so i come here to ask, if anybody has had similar situation and successfully asked congressman/senator to directly get involved. they claim they can do nothing about fbi check, but now the ball is in NSC's court and NSC really owes me the approval letter right now. (my RD 11/20/2001)

btw, i made three inquiries to USCIS

which MIGHT be helpful.

my first FP was in may 2002, and second in january this year. i have no idea for how long my case had been stuck at fbi. i started filing incuires to uscis this past june. i also started calling congressmen/senators around that time.

the content of the replies from USCIS to my inquiries is meaningless -- they just kept saying it's within normal processing time, due to fbi check ...

but i guess it doesn't hurt to keep filing inquiries and contacting congressmen/senators for our long-delayed cases ... you never know which one could be the magic button...

update

just got a letter from senator. that LUD (09/14) was actually the assignment of immigration examiner. "a final decision will be issued within the next 30-60 days" so, it's getting close ...

wish me luck, and wish you all luck!

approved!

first, to npnkan02: i have a job at an east coast state although my primary residence is still in mid-west where my wife works, so i called/wrote to ALL senators and congressmen here in this state.

now back to my approval. got email last night (sept 21), saying this case has been approved. called the 1800 number, and checked the online message, both saying approved.

well, i guess the approval occurred after noon time. around noon time, i made a phone call to change my address. couple days ago one senator's office noticed my mailing address was different from the receipt address, and told me they changed my address (without notifying me)! to make sure everything is fine, i called yesterday to "formally" change.

now, this creates a funny situation.

this morning, i got another email from uscis, saying 'on september 22 we responded to your request for more information' blah blah, and yesterday's message about my case being approved has been replaced by this one.

i called that 1-800 number. they said they didn't have historical record, and could not verify the approval. all they can see is the same as what we see -- the most recent 'status' (and for my case, the most recent status is that LUD) sigh, what kind of system is that?!

i'm not worried at all -- i have the email notification, and one senator's office called earlier this morning to congratulate me.

well, i guess this is a very appropriate concluding remark for my three years waiting. on one hand, i appreciate the work/help from all the people including those at uscis. on the other hand, this system really needs to be improved, and some improvements could be made so easily...

best luck to you all!

Congratulations man!!! That is extremely good news to me. Now I believe that miracles do happen. Cause this for sure needed a miracle, as my case.

Remember my earlier post "I think it's only a matter of days." Why can't I say the same for me?

Ofcourse it is a good news

chris_t Congratulations . You deserve a big party...

npnjan02 You are also too close. Good Luck..

npnjan02, write to everybody who could help

this doesn't hurt. i'm sure your time will come very very soon. my understanding is that it's not a very complicated or time-consuming process -- if somebody can help you somehow get their attention, you'll get it very quickly. in a hindsight, i should have made those phone calls long time ago ...

again, thank you all, and best wishes
