How it works company to company shifting of H1 and going back to old company if It is not a regular H1 transfer….?

Few months back I worked for a company in USA and have a valid H1 stamping in my passport till 2005. But in the meantime I got a good offer from one of the leading Indian software company and they processed my h1 as new h1 (not h1 transfer) and they get my new h1 stamping in my passport. That time US consulate cancelled my previous H1 which is valid till 2005 “cancelled with out prejudice” .

Now again I want to go back to my old company by resigning to my current company (Indian based company). To do so, shall I approach US consulate in India with my old company’s H1 to get h1 stamping with old company’s H1 approval notice?

Please advice me with details I really appreciate your help in this regard.

Please note my first company not going to cancel my H1 till I come back to that company or till expired of my H1.

No. Even if the original company has not cancelled the H1, that h1 is no longer valid because of 2 reasons
1. You have not worked for them lately. (there is a 60 day rule that lawyers use)
2. US consulate cancelled the visa.

Either file a h1 transfer or file a new H1 before starting to work for them again.

Today I talk to Bombay US Consulate, they told me that, if you get a letter from your old employer stating that we are re-recruting this candidate, we will issue visa on old H1 paper. Is it not possible?

If the consulate has said that, why are you asking the question again here? Good Luck.
