How good/bad is my case with AC21

Hi Gurus,

Just need your thoughts on my case to help make a decision to use AC21

My case details
EB3 (PD July 2002 -Sub)
I-140 Approved (march 2005)
I-485 ND (March 2004) AD ???

I have really good offer where my salary is about 50% more, tecnically I will be working for a same client when my labour was approved but thru a different company of-course.

with New Yate's Memo as I have I-140 approved and itz been more than year since I applied for 485 what are my risks by using AC21

My current may not revoke I-140, but I can't say that for sure
 
You should be ok to use AC21. Just make sure your do an H1B transfer instead of using EAD as it will protect you under any unforseeable circumstances. Get a copy of the original LC with job description and keep it same in the new offer letter when applying for AC21.

Get a copy of the original approved LC form ETA750A and check item13 for job description and keep it same in the new offer letter when applying for AC21.

-------------- copy of approved LC may be with lawyer who filed LC or I-140 and he may not give you without permission of employer, talk to employer or HR
--------- if I-485 is NOT approved before the end of June then wait till October 2005 and see the Visa Bulletin if the PD becomes currunt or cut off date for your country of birth in EB3

*** why dont you take the printout of Both AC21 MEMO and read in detail. they have been posted on this thread and on many sites. if you read them in detail you dont need more info
