Hi Guys,
My 2nd EAD will expire by end of DEC,2003. How early can I apply for extension? It used to 90 days but I have seen people applying sooner too.
Thanks

No RFE so far

6 months in advance

My second EAD is expiring Feb. 2004 and I have initiated the renewing process with my attorney. Better safe than sorry! And I think this should be my last EAD otherwise I don't think I can get my GC anyway.

I have applied my first EAD renewal befor 117 days, no approval yet on 2nd EAD. Since the processing time is saying 90-120 days for EAD approval, I think it is better to apply atleast before 4 months or 120 days.

I applied for my second EAD on third week of september and got the card yesterday. So it looks like it is pretty fast now.

It would be safer if you apply prior to 90 day mark. If the EAD doesn't come through by the time your old one expires you can go get a temporary EAD from local office.

Eventhough you can apply for EAD renewal as early as 5 to 6 months, think of both cases below before you send tooooooooo early.
(1) Since Jan 02 cases are being processed (unofficial observation), may be your case would be aproved before dec 03. If your H1 is still vaild and you are working on H1, delay sending renewal of EAD application.

(2) No if you have already started working on EAD, do not take chances by delaying. just apply as early as 3 months+10 days, assuming that if necessary you can go for IEAD. (unless IEAD rules change)

In any case, I would say "Good lucK'.
