How early can I apply for H1-B stamp at the consulate?

Dear friends,

My H1B has been approved recently but my job start date is Sep 1, 2006. I want to apply for a stamp as early as mid-May. I have other complications about my visa and by applying early I will know whether i can have my H1B stamp.

My question is whether someone can apply for an H1B stamp at the US Consulate/Embassy over 3 months ahead of the job-start date as specified in the H1B approval? I know that if H1B stamp is given one cannot enter the US 10 days ahead of the job-start date. Is there a similar minimum time requirement for H1B stamp application at the US Consulate as well?

The answer to this question is very urgent for me and I'd be more than appreciative if you coule please advice me on this.

I thinks its better that u apply for visa stamp ahead reason being due to security clearance MAY be your NAME has a false hit and your case has to go through administrative processing which may took 3-12 months or may be longer. This is just a preemptive strategy for applying earlier i myself waiting for the last eleven months. On us embassy websites they mention it to apply early for the visa is very much recommended. Well thats all the information i experienced during the visa process. i hope this may help u.

Have a look at points 5 and 6 in http://travel.state.gov/visa/laws/telegrams/telegrams_1397.html .

My interpretation: Ordinarily you cannot apply more than 10 days before your start date. This was relaxed for FY2005 for consulates that expected a rush. Which means, each consulate can choose whether to exercise that option or not. I had emailed the consulate in Mumbai and they told me that they accept H1 applications in advance (no earliest date specified). My guess is that it would be the same for other consulates in India. To be sure confirm with the consulate you are going to.
