wondering about this....

if a B visitor files an extension.. and during the wait ... they become eligible for AOS, do they immediately submit the AOS? or do they wait for the answer? Do they wait 3 months after the extension before filing AOS?

also.. is it taking about 4 months for extension processing now? says on uscis they are working on October now?

To file for AOS, one does need to wait for the adjudication of an I-539, if it is in the works.

Thank you for explaining. It seems in some way right but
in other ways wrong.

If I-539 is: Denied
AOS could be instantly applied for,
except B visa holder cannot travel until GC in hand?

but if extension approved:
Advance parole available during GC processing
AOS can be submitted 90 days from approval letter?
or is it 90 days from time extension began?

You can utilise an AP document as long as you did not accrue more than 180 days of illegal presence from the I-94 expiry to the receipt date of your I-485.

I thought it was different then that.
with all the 222(g) stuff on the forum I am confused I guess

I read a page saying someone can't leave until finished with AOS
but maybe you are more right
http://en.wikipedia.org/wiki/Re-entry_permit

if a B visitor has their extension denied, then their visa is not good any longer
so how does the AP allow them back in? Is it like a visa?

sorry for asking so many questions.
