How does one Reply to RFE

Hi Gurus.
I am a bit lost as to whether I should use scan copy or original for RFE reply.
I got the following RFE from INS

Submit one additional statement, sworn to or affirmed by a person who was living at the time and who has personal knowledge of the events you are trying to prove, for example, the date and place of birth. The person making the statement (affidavit) may be your relative and need not be a citizen of the United States.

How does one reply to this RFE. I am required to submit Birth Certificate Affidavit from my uncle and aunt. I have got those copies scanned in color from India. Would that work as a reply or Should I get the originals and then use originals for replying to RFE.

My attorney tells me to just use the photocopy. She says they never send anything original to INS. Only photocopies. I am thinking if originals will appear more authentic.

Please let me know how you have submitted RFE responses.

Thanks a lot for sending the URL!! I just checked it. However they say that for affidavits we need to submit originals :

If a supporting document is prepared by the issuing authority solely for the purpose of presentation to USCIS, an applicant or petitioner must submit the original document with the application or petition. Examples of supporting documents which must be presented in the original are:

Affidavits prepared in place of unavailable documents (e.g., an affidavit in place of a birth certificate where the official records were destroyed by fire)


In my case this affidavit is solely for the purpose of presentation to USCIS. Nobody else cares about it. So should I send them originals in such a case ? :confused: :confused:
 
Since you can always get another Original in case if you need it again from your Uncle and Aunt, so If I were you, I would send the Originals as TIME is of more importance here in GC process and you don't want CIS again asking you for Originals or transferring your case to Local offices for further verification. This is my opinion.
 
I agree with needhelp1. Plus, it also says clearly on the website that you should submit an original if it is in place of an "unavailable document".

Send in the original for your RFE response and if possible (and to be on the safe side), ask for another set of affidavits from your relatives right now. You may not need it after all but will save you some time if the need arises.
