When I140 is approved , do they also mention names of the dependents on i140 approval notice ? how do we now that dependents are included ?

What happens if attorney didn\'t mention names of the dependents while filling I140 application ? can you still go ahead and file i485 for dependents as well.

If it is not in the I140 approval...

You can still apply. What happens is that dependents also get Alien numbers allocated in the I140 approval if included in the 140 application. In many cases, aliens are not mentioned in the 140 approval, but later added with alien numbers in the I485 receipts. Only at 485 stage, keeping the applications together is critical.

Buddu Kaika.

How the hell one will know your dependents at the time of filing I-140.
You may get married after filing I-140
You may have children after filing I-140
You may divorce and marry another spouse after filing I-140

Dependents question will come when your changing your status from non immigrant to immigrant status. And at that time only we need to give dependants information

you are fucking idiot

How the hell one will know your dependents at the time of filing I-140.

Why not ? what\'s so difficult about it....... everyone else is not popping kids left and right like you do. everyone else is not going to divorce and marry the way you do it.

so you are not the model for us. If you are fool and doesn\'t have sense doesn\'t mean everyone else is like you. got it bastard !

it\'s so confusing. first you have to apply and later you recieve reciepts.

did you mean to say that just apply together for i485 and when you recieve i485 reciept they will asign Alien number to all of them.

Yes Apply together. Alien numbers will be assigned and they will be recorded in the I485 receipt notices.

The employment based green card is divided into three steps
a) Labour certification - this is to show that labour market requires people of your qualification and the job requires people with your skill and knowledge

b) I-140 - this focusses on your company and its background and yearly income , balance sheet etc and its ability to pay your salary and its need for a person of your skills

c) Adjustment of status - focusses on you and your wife and kids - It also checks your criminal activity if any and records your birth certificates and your dependants birth/marriage certificate and if you and your dependants are in status when filing I-485.

Hence to come to the point of your question - No the I-140 does not concentrate on the dependants but only on the primary applicant.
This is taken care of by the I-485 stage.

Hope this helps.

Please don\'t use bad language

It does not help anyone and it leaves a bad taste. Also, everyone is encouraged to ask whatever questions they have in their mind.

Like rsgc said, the dependants get their alien numbers assigned during the I-485 stage. File the I-485 for the dependants along with the primary applicant. They will all get their alien numbers mentioned on the receipts.

I-140 is about the primary applicant and the company\'s ability to provide employment to the applicant. The primary applicant gets the alien number on the I-140. Going forward, the A# becomes a key to everything related to GC process.

Can I file my 485 first , then file 485 for my dependents later?

I just got approved recently my I-140(EB1) and need to get EAD urgently. However, my dependents are currently not in USA, but should be here in a month. Can I file my 485 now, and then file dependents 485 later when they come here? I read somewhere said dependents can only apply 485 once principal applicant 485 get approved(which is too long). Is this true, or dependents can apply 485 once they get into this country?

I would appreciate your guru\'s comment about this.

DRC, answers to your questions

Q1. Can I file 485 now, and then file dependants 485 later on?
    - Yes, you can file I-485 now if you have your I-140 approved
already. You can always file your dependants I-485 later. It
would be wise to file I-485 now to save overall processing time.
It is not advisable to wait for principal applicant\'s approval
of I-485 to file dependants AOS cases.

Q2. Can dependants apply only once principal applicant\'s I-485
    gets approved?
    - False
Dependants can file I-485 as "derivative alien" once the
principal applicant gets I-140 approved under Employment Based
category. If the dependants try to file AOS after the principal
gets approved, they would come under family based immigration. I
believe that the family based immigration takes much longer.

Bottom line - do not delay filing of your I-485 if you already know
that your dependants are joining you. Keep copies of
your approved I-140 notice to file their I-485 later on.

Hope it helps. You may also talk to your immigration lawyer for better
advice.
