How do I know if an H1 is filed with INS? ginnu, saigc pl reply

Hello Gurus,

Is there any way of knowing if an employer has filed an H1 with INS, such as calling INS and providing the name of the person and asking if the H1 has been filed for that person?


Any comments or suggestions would be helpful.

u would get a receipt number from the CIS for any application filed. Ask your employer for the receipt number

I asked my employer for the receipt number, but he said he has not received the receipt number yet.

According to the employer, the application was filed on September 24th, 2004.

I am currently on H4 and I am slowly losing faith in what the employer is saying and would no longer like to work for him.

That's why I am looking for a way to find out if the change of status from H4 to H1 was really filed. Is there any way to call INS directly and ask if the H1 was filed?

If the H1 is filed, then I would like to change the status back to H4. How can this be done?

If the H1 is not filed, then it is good for me as my current H4 is still valid until Nov. 2005.

Alternatively, is it possible for me to continue to stay in my valid present H4 status, if I do not hear anything from my employer?

------- normaly USCIS sends filing reciept in 10-20 days, the check employer sent as USCIS fees if that check is cashed by USCIS then back side of the check is the reciept # you can check with reciept # the status of your application IF the employer or lawyer who filed your application can provide you the copy of Cashed check (front and back)

------ it can only be done if you get H1 approval notice , if employer never filed H1 then you are on H4 status, if your H4 is going to expire then file H4 extension and you can file H4 extension with form I-539 and 6 months advance of your I-94 expiry date if you file H4 extension then it will be latest application from your side
