How Do I Go to Canada without having my Passport Stamped???

I landed in Canada more than a year ago and came back the next day. US INS stamped my passport as my I-94 had expired then ( I was on advance parole). Now after a year, my GC is still pending. My question is how do I go there and come back without being detected?

Thanks for posting your experience.

bhasin, by ‘stamping my passport’ I meant, they gave me a new I-94 and also put an entry stamp as they do at the airports when you come back from overseas.

j22, US INS and Canadian immigration are not related. So, what you do with the Canadians is none of US INS’s concerns. Only thing is that when you land in Canada as a Canadian permanent resident, they put a stamp on passport. That stamp does mention that you landed there as an immigrant. I did tell the USINS at the border that I went to Canada to land. First they did not like it and started asking questions. When I explained to them that I read the laws and I spoke with INS and they said it’s OK to land in Canada they let me in.

Nandit, Please help with your inputs .. I really appreciate your clarification .. unfortunately it may cause a major problem in my case, I am really getting confused now ..

a) I do not have a \'valid\' H1 visa \'Stamped\' in the passport .. all I have is old H1 Visa that expired last year and I 129 approval (H1 renewal) so my POE I94 which was valid upto the validity of the visa stamped in my passport is now expired. The I 129 comes with a I94 card.

The case is same for my spouse who is on H4.

b) My US GC 485 has been filed .. so I can not risk getting a new I94

What do you say ? Am I in a fix here ?

PS : I am told that as a Canadian Landed immigrant you can enter US freely (without stamping) .. so why did they stamp in your case ?
