I have been reading that if your ead is not received before the previous one expires then you can take a leave of absence and that is ok- my understanding is a little different- EAD is required for employment. how can you be an employee even if without pay if you are not authorized to be employed because your ead expired. if you are getting benefits you will still be considered a employee as they are benefits to a employee and that is against the law if ead expired- am i wrong or is there a different interpretation of the law.
For example if you take unpaid leave secondary to medical reasons and get only benefits you are still an employee- correct- so if you are getting benefits of employee when you are clearly not authorized to be employed that should be construed as unauthorized employment as well.

EAD= employment authorization which is not same as authorization to work.

I would like feedback please

USCIS doesn't care if you get benefits or salary; they care if you are WORKING. If you are getting paid to sit at home, you don't need employment authorization to do that.
