How can I change my statys to H4 from H1

Hi,

I came here (in H4 visa) as dependent under my husband\'s H1. After we came here, my husband changed his job and we both changed our status to new company (My H4 was also approved from this new company). After few months, I also got a job offer and changed my status to H1 and started working. But, recently, I was laid off. Now my question is:

1. Do I have to change my status to H4 immediately now OR I will be in
   status since my latest H4 paper shows validity date till 2004 ?

2. If I have to cahnge my status, how can I go back to my H4 status ? My
   husband is still working in the new company where we both got our H
   visa approved. (His H1 and Mine H4). What papers do i have to file ?

Easiest fix...

Just go out and come back (like to canada) to get the new I94 based on H4.
Filing a I539 is the only other option. But if you cannot go out of US now and are willing to wait 6 months to receive the paperwork, this will be your option.

Dunno whether post sept11 staying here without a valid I94 (technically) is advisable or not.
 
Urgent ! H1 to H4

Hi,

I got laid off. My spouse is on h1.How later can i convert to H4? any problems anticipated. and what documentation is required. any help is appreciated. thanks
