My I-140 for CP was received by the Texas center in March 5th, 2004, but now I am not sure if I will still have my job by the time I get an interview (somewhere around late 2005), can I change from CP to AOS, so I can file the I-485, AOE, etc... ???

Thanks in advance !!!

One option is to wait till 140 is approved.

Other is ask the lawyer, if another 140 can be filed?

Once you getyour I-140 Receipt Notice (Not Approval notice), you can submit petitions for Adjusting status (I 485) for yourself and all the dependents. Please make sure you include your I-140 Receipt along with the petition. You can also include petitions for EAD, and Advanced parole etc. along with this petition. Things are a bit more difficult if you opt for CP after filing for AOS. In that case you have to wait until the I-140 petition gets approved. NOT IN YOUR CASE. So good luck.

THANKS!!! for the information, but these are such a good news that I need to ask again just make sure :

I already have the receipt notice of the I-140, but again this I-140 indicates that is for CP but of course the receipt notice does not say anything about it, so what you are telling me is that I can file a I-485 even that the I-140 indicates CP at longest I attached the receipt notification and that will be good enough to change it from CP to AOS ?????

Sorry to ask again but this is so critical to me that I need to make sure.

Thanks

Write up a letter to USCIS and state that you and your dependents would like to change the last stage of GC from CP to 485. Include with this letter your I-140 RECEIPT. Once the USCIS has received it they will make the change in their system and more than likely issue another I-140 receipt stating that you are on 485 track. Once you have received such a receipt/ such change has happened @ USCIS then you can file 485 papers and pursue EAD/ AP.

Does the 140 rct. have Adjustment track on it? (Myself, never seen an 140 rct.)

When the concurrent I-140 and 485 deal started thats when I-140 started stating 485 or CP track somewhere in the I-140 receipt. Has it changed? This was done just as a way for the applicant to review and make changes if there was a mistake made by USCIS.

Oh! OK.
I don't know if it has changed or not, as I indicated, I have never seen an 140 rct. before.
