Hi I will really appreciate any help in this matter. I am on H-1 Visa and my wife is US citizen. I have mother back in India. Can anyone guide me what to do in order to call my mother to live with us on permanent basis( not 6 monthly basis).
I am very much stressed out. Please help.

thanks

There is no shortcut here. For one thing, you have to apply for GC first based on marriage. Then wait for about 3 yrs until you can apply for your USC. Then you can apply for her GC. This might take a while.

legally takes time

as Mikew explained, the legal way will definitely take a long time.
illegally - may be lot faster :D who knows !!!!!

IL state govt gives state medical assistance without even checking their visa status.
For Illegals please come to US - make a baby, then we pay for ur health ins since we started this new " access to care".

For Legals please wait in line for qtr century........

so now we come across illegals eating up our tax dollars and cutting in to the immigration process.

for your MOTHER, you will have to

first step:
get a green card for yourself, you can do this thru 2 ways, one ask you wife who is the USC to petition for you, or you can ask your employer.

2nd step:
after you get your green card, you have to wait until you get your citizenship. only citizens can apply for their parents, and your wife CANNOT apply for YOUR mom. (sucks i know)

time to wait for citizenship:
either 3 years if you are asking your wife to petition for you and if you have been married more than 2 years
or 5 years, if you have been married less than 2 years, or got your GC from your employer.

after you get your citizenship you can apply for your mom, either from here, or from india. it will then take about 1 year to get her a GC (if god forbid she is not stuck in the crappy namecheck).

When I read the post I thought you was needing help with "calling cards" hehehe. Sorry.

Everything is pretty clear, you must be US citizen to apply for your parents. So even getting the permanent residency (that in less than a year you can get it through your wife), you must wait three more years to apply for the citizenship, so then be able to apply for your parents.

It's all true, except:
to candyattitude: Regardless of how many years you've been married to USC, you can apply for citizenship 3 years after marriage based GC.

Vineetall, if your mom can come here on tourist visa and stay, her overstay will be forgiven at the time you apply for her GC as a USC.

anahit i agree with you..but it's 3 years after removing CONDITIONS on the GC which they give you if you have been married less than 2 years. and to remove conditions you have to wait 1 year and 9mnths. so if you have been married less than 2 years you have to wait approx 5 years to apply for citizenship. (3 yrs + 1yr and 9mns = 4 yrs and 9mns)....that's why i broke it down like that.

This is misinformation. A person can apply 90 days before the 3rd anniversary of becoming a permanent resident if married to a US citizen. This includes conditional permanent residence --- of course other conditions apply.

In many cases until recently, the N400 was filed, even when the I751 has not yet been approved --- I have found this to be an effective way to speed up the I751 application. In several cases, the I751 interview was conducted concurrently with the N400 interview, or on the same day.

These days, it is less of a problem --- I751 applications move faster. Please research carefully before posting.

so you guys are trying to say that if i get approved this october 2006 on conditional status (b/c i have been married for less than 2 years) i can apply for citizenship in october 2009???? are you guys SURE about this???

Yes, in fact, you can apply 90 days before that date.

pianoplayer is right, I asked the officer during my interview after she stamped my passport and she said that in 1 year and 9 month my wife and I have to file the papers to remove the conditional green card and it will become a permanent GC. To become a USC it's 2 years and 9 month after the interview when I have been approved for the GC.

If you get approved in october 2006 Candyattitude, you can apply for the citizenship as soon as August 2009 :)

hey guys, thanks for the info...i totally DID NOT know this!!!!.....this is great to hear....

And please... in the future if you're not sure about something, don't post it as fact and then argue with the person trying to correct it for you.

Thank you.

We're all here learning from each other's knowledge and experience! :)

I fully agree with that. But it's annoying when people spout things out without prior research and misguide people.

agree with anahit. it was an honest mistake so there's no need for the crap talk pinturicchio.

The only crap talk I can think of right now is your previous statements and the manner by which you hung on to them.

Again, this is not aimed at you specifically. It's a general request for fellow members to do some research before posting something as fact.

well i agree that i made a mistake and i even admit it. i didn't continue to spout things out w/o any research. in fact i even went to the website and others to search up the info. and my mother-in-law told me later that it's 3 years. however, why i said "crap talk" is b/c your telling me how to behave. your told me, in your post, that i shouldn't continue arguing with whoever. what am i 5 years old? adults usually correct the behavior of children. who are you to tell me who to argue and not argue with?
i understand your point about not posting things w/o first checking it out and i agree with you on that. it's my bad. i totally should have done it. however, if i want to argue with a 100 ppl then that's my thing.

Ok, I'm going to explain myself. Hopefully, this'll be the last of this nonsense :) I wasn't telling who to argue with and who not to.

See the posts quoted below. First you said something incorrect, and then when corrected, you insisted on your statement even though it was incorrect and unresearched.

That's what I annoyed me.

Pinturicchio,
One would research something if he/she has doubts about his/her knowledge of the issue. Sometimes, a person does not even think about checking it out because he/she is positive of the info he/she has.
And, that's exactly what happened here. There is really no need to get upset!
I am glad that Candy, and I am sure others, learnt from this thread. That's what's important! :)
