Hourly Wage H1 Question

Hello all,

Would an hourly waged H1 employee be considered "out of status" if he/she was to take an unpaid vacation for a week or two during the year? The employee would still be an employee of the company, but just not be paid for 2 weeks out of the year... Is that possible?

Also, what are other possible disadvantages of Hourly vs Salary based employment?

There is no difference, if tax is not deducted from your hourly wage then it is problem, you will not have W2.

Taking vacation on either case is legal.

Another question that I have is whether I would be able to work on two different projects at the same time while under one employer. For example, working on the weekdays for Project A in Company A and working on the weekends for Project B Company B doing VERY SIMILAR things, while sponsored by Company C at all times.

(Basically asking if a consultant is allowed to work in two different sites or not)

As for as you are taking pay check from your H1 sponser, work for 100 projects, if you can, do it my friend.
 
EAD and H1B

Can i work on EAD for company A and work on EAD as second job for company B ( they sponcered by H1B), so i keep my options open to go back on H1B if need be.
H1B is valid as long as i keep getting paid from company which sponcered my H1B.
 
This is grey area .... I had done some reasearch on this in the past.... contacted a few lawyers/gurus on this forum.... Got mixed views/replies ...

All agreed for one thing ...Its best not to work on EAD if you can help it...

Using EAD pretty much abandons your non-immigration intent and the requirement to work for your H1 employer...You cannot switch back to H1b once you begin working on EAD.
