Hot Line Questions

I guess few of us have access to the 'hotline'. I suspect most of us have the same source (some may have different sources). I want to collect all the questions that we should ask while not necessarily repeating them. I don not want to annoy my contact (and the contact has been annoyed) so I call it once a month. Some time out of sheer frustration I have called and either did not ask all the questions or did not even ask the right one. I want to collect all the questions (I would guess in one go asking up to 5 different questions is OK) so that people who have access can ask the right questions and if something was missed then the other can pick that up...So fire away.

You know most of the questions we all want to ask...

1) Have they started processing RIR & Nor RIR cases ? Or Still Training Only.
2) What is the current speed (rate)... Cases Processed per Day, week or month
3) DOL cases will be done first & then SWA cases or all togather.
4) When will Full Forced Processing Start ?

I believe BPC has answered your first two questions many time..

1) Order of Processing : Priority Date
2) Seperate queue for RIR/Non RIR : YES
 
Hotline Questions

Akela,
Great job. Keep up the fantastic work. You and other "hotline" folks have given us all hope.

Here are some of the questions that I can think of right now:
1) What logic is being used at Dallas and Philly BEC to process cases? FIFO, LIFO, earliest PD, etc.?

2) Are there separate queues for RIR and Traditional cases?

3) What are the current dates (if PD is used) being processed for the RIR and Traditional cases?

I am sure you will be inundated with more questions pretty soon.

We dont want to be repetitive in our questions, we know a few things like:

1. 2 separate queues for RIR / TR (non RIR) but resources will be shuffled as and when need arises. DOL wants to keep both queues in synch with dates

2. DOL cases from Philly first. Then SWA cases.

3. Adjudication by PD

Lets not ask these again and again and again --

I think what we need to know now:

1. Have they really started adjudicating, we're hearing of cases that have recd approvals in this week.

2. How many days after 45 day letter response is sent can we expect to hear a response. There was some talk of a 90 day turnaround after 45 day letter response is sent.

I am not sure anyone can answer questions about how many a day etc without a huge guess on their part... so even though I'd like to know the answer to that, I suppose knowing how many days after 45 day letter response is sent -- should give us better insight.

concerning the two queues that u talked about. if what u r saying is true, it means indirectly that there is one queue effectively because basicaly most of the RIR cases r backlogged from year 2002 and up whereas around 2/3 of the total backlog come from the NON-RIR (TR)cases filed in april 2001.

in other words, if RIR and non-rir will move with the same dates it means that most 2/3 of the backlog that is TR cases will be cleared before any RIR will be cleared. therefore it is a very long wait for RIR fellows unless the two queues r separated completely.

Can we ask about Regional DOLs Queues?
if so,
1. Will Regional DOLs (SFO, Boston, Atlanta, Chicago) continue to work on the Queues.
2. If so till when.
3. SFO has a seattle and a western states queue, are they different of the same.
4. How many resources/personnel are working at these Regional DOLs.
5. Will the http://workforcesecurity.doleta.gov/foreign/times.asp reflect the progress of these Regional queues?

Also DOL has already provided answers for some of your quesions earlier.

SF, NY & Boston Regional DOL will continue processing cases till Jan-2006.

It has allways been different queue/ different staff

Very Few.. We will have to ask the exact number to each DOLs directly

another question that i think would be useful to answer.

will RIR and TR queues be completely independent from each others, or will they will go in parallel so that their timing r very close or synchronised? if they r not completely independent, it means RIR fellow r screwed up big time.
 
I hope the same set of questions apply for both the centers.. The reason I am asking this is.... We have read elsewhere under this forum, that certain lucky people have got their approvals and all of them are from Dallas... Nothing from Philly. So has Philly not started processing any cases yet?

The obvious question would be what are the priority dates of the cases being processed at both centers
 
Is it Ok to convert to PERM?

Fellows,
Is it good to convert to Perm from RIR. MY PD-LC catagory-State is 9/2003-EB2-MI, and it looks like my contract with current company will be terminated in next june/july. Does anybody has idea how conversion is going to be handled?And if it would be ok to convert to PERM from RIR what are the chances that I lose my PD or EB2 catagory?
Anybody's input is greatly appreciated. I am sure many will be having same dillemma as mine. So please help...if anybody can..

DOL changed the content of this page ..there is no processing times wrt to DOL regional or states.,
we have to wait and see what they publish here this month.. the same Backlog schedule or processing timings at BEC or processing timings at remained regional processing...?
 
questions for Indiana SWA

My questions are below:

Are they (BEC) done entering Regional application yet? I saw a person from Florida SWA with priority Dec 2003 got the 45-day letter.

I would like to know what position in the Q is for Indiana SWA application as far as being entered into the system?

I have been waiting since May 2001 at Indiana SWA. I understand why they should process regional application first. but why they now don't follow the SWA priority date, that is my concern.

Please seek the answer for me. thank you very much.
 
Does anybody have any idea how they (BEC) organize all the cases?? By priority dates or State or both (State and priority) ? The reason that I asked is some state doens't have a lot of cases in queue. So would they process that state first?

You can see how randomly they are sending 45 day letters...??? There is not queue for that...I assume intially there will not be any special queues...like you mentioned....forget your suggestion...they do not even have queues for RiR and TR...they are all one based on PD.

1. Transferred all backlogged cases in SF DOL to both Dallas and Philly in equal numbers.
2. Transferred Philly/Dalls DOL cases to respective BECs.
3. Transferred some, and not all cases (last i heard) from Chicago and Atlanta DOL to respective BECs ie Dallas and Philly.
4. Asked All SWAs to start sending data.

As the data arrives at the BEC it is being entered in their system and 45-day notices are being sent. First they entered all DOL data and have completed that, next they have already started data entry for the most backlogged SWA states.

Other DOLs continue to process cases that they have left and will continue to do so till their Qs are exhausted.

In the meanwhile, back at the BEC:
THey have started adjudicting based on PD for cases in DOLs and then will adjudicate based on PD in SWA cases. In other words, all DOL RO cases that have been sent to BEC will be adjudicated before they start state cases. This may change but it is highly unlikely.
