Horrible news: EB3 Priority Dates 5 years behind

They just released the priority date for September and the date is 5 years behind. So people who have only I-140 pending, good luck and sit tight.

What do you mean? Can you please provide some more details on what are you trying to say.
 
my lawyer gave me the news from AILA press room. here is what they published word by word on AILA site

On August 20, 2007, Charlie Oppenheim, Chief of Immigrant Visa Control and Reporting at the State Department, discussed with AILA Liaison informal projections on employment-based visa availability for the October 2007 Visa Bulletin. Speaking broadly of visa availability in the First and Second Preference categories for all countries, visa availability for October should closely match that seen in the September 2007 Bulletin. In the Employment Third preference categories, the cut-off dates are likely to be similar to those found in the January 2007 Visa Bulletin. For the Other Worker category, expect the cut off date to be 10/01/01. The State Department does not yet have enough data to project Employment Fourth Preference. Finally, members should expect Employment Fifth Preference to go current for all countries.

Among the pieces of good news is that all numbers available under the FY-2007 Employment annual numerical limit will be utilized, a goal the State Department sought to achieve by the dramatic advance in visa cutoff dates reported in the July 2007 Visa Bulletin.
 
even though the Visa bulletin dates change every now and then, the last time they reduced the wait time from 4.5 years to corrent took 2 years. still a long time for many people.
 
sorry guys, I don’t want to be pessimist. But lots of people need to think about alternatives since the 7th year H1 extension can only be done for up to total of 9 years (from day one to 9th year extension)

ask your lawyer my friend. if you have a I-140 on file, waiting for adjudication, you can extend your 7th year H1 (one year extension only) and you can continue getting 1 year extension up to 3 times. now they say if the I-140 is already approved they may give a third time 3 year visa but i have seen immigration approve only 1 year.
 
You can get H1 Extension until you get the GC. So dont worry about that .

as Oct Visa Buletin Prediction will be May 01 . So it More than 6 Year Backlog in EB3.

God know what will happen. if get GC you are the lucky one in the USA.
 
and agian if I140 approved you will get 3 Year . One of my friends got 3 Yar extension already two times. So dont woory about that.....
You have to double check with your attorney !!!

Never heard of the 9 year cap. After your 6th year, you get yearly extensions if your labor application has been pending for an year. Or a 3 year extension (if requested) if you have an approved I-140.

I'm already on my 11th year on H1-B. You can extend your H1-B until GC process has been completed. Got my EAD last May and just had my I-140 approved this week. Still hoping to get my GC this year. My PD is 4/30/2001, EB3 (Philippines).

the cap is 6 years. having I-140 is special situation that they kind of put there to ease the waiting pain LOL with the new bulletin good luck to a lot of us. cheers

Everybody needs to do their "time". I have waited now for 6 years, so I don't know how and what will change to dramtically reduce the processing times.
Patience is what is needed and need to take it with a grain of salt.

i can already see that waiting 6 years have changed you. the point of this Thread was to inform people that the line is getting longer and longer and some people may have to think about alternative solutions just in case during the long waiting period something may go wrong.

Question: Recent "Priority Date Current" fiasco, many new comers benefited (suc as PERM labor). How about old folks like us (labor is pending in Backlog)? When can we file I-485 once backlog labor is approved? My backlog PD is October 2004. What will I do after Backlog labor approval?

I think it's unfair on USCIS/Dept of Labor. I am sure they must have gotten thousand of applications and visas may not be available for another 5 years. So am I stuck for 5 years? OR will there be another "Current Date" bulletin?

the priority date is when you filed the initial labor cert either perm or the other one. so visa bulletin has nothing to do with the old or new LC. i would ask my lawyer to follow up on the LC though. the deadline to end the old application is within next 3 month (if i remember it correctly)

unfortunately there are not many options on the table. i can only speak for myself and i think it is better for me and my family to go back and wait for the consular processing instead of AOS. 5 years wait just to apply for the residency
and EAD? i get the feeling that immigration retaliated to the failure of immigration reform by making such a mess and i don't want to be the victim of political battle between congress and administration. :mad:
