Today, i had a horrible experience with BCIS. As i have told earlier, i have applied for EAD extention on July 28. The RD is July'30. My current EAD expires on Nov'19 (2 weeks left). BCIS has sent me an RFE on Oct'5 and i have replied to that RFE on Oct'7. I have an acknowledgement with stamp, that shows that BCIS has received my application on Oct'8. Two days back i have called BCIS customer service and they said that they have received my RFE response on Oct'21. It is a big lie. Then they told me that i can goto local BCIS office (Norfolk, VA) to get interim EAD because my case is pending for more than 90 days. Today i went to Norfolk BCIS office and they simply told me that i have to wait for 90 days from Oct'21 (the day they received my RFE response). I tried my best to persuade them to issue iEAD because the RFE was actually a result of clerical mistake at VSC (they have looked at my wife's drivers license copy to check my date of birth and sent an RFE saying that my date of birth do not match with the one shown in the DL. They asked me to send the date of birth certificates). It was no use. After much persuation, the Norfolk BCIS supervisor told me to wait till Nov'19 (the day my EAD expires) and then comeback to them. Then only they will talk to VSC. So i have to live with anxiety for the next 2 weeks. My H1B got expired in February this year.
SO BE CAREFUL WITH BCIS. TRY TO APPLY FOR EAD RENEWLS 6 MONTHS BEFORE EXPIRY.

ARE THERE ANY STRONG SUGGESTIONS FROM YOU FOLKS ????
We should report my EAD renewal case(experience) to AILA.

Nowadays everything is so uncertain in life, you never expect what hits you next second, forget next day. Suddenly it completely changes your attitude and outlook towards everything.

It's unfortunate that our lives depends on some idiots decisions.
 
EAD is another useless document. To approve this useless document they create all sorts of confusion.

I have also applied my 3rd EAD. God knows what happened next?

Sorry to hear about your situation.

Looks like now people need to apply for EAD renewal 6 months before the current one expires as a contingency for RFE on EAD.
 
dsatish, wish you good luch with the EAD. you might get it before the current one expires.

as for BCIS, it looks like we may have a chance to get GC if we started the application before we were born..

I have already decided that as the back up plan. All these problems are because my typical desi consulting company refused to file my H1 extension saying that i already have EAD. They asked me to pay $1500 if i still want to file the extention. That was a big money for me and i never imagined this type of problems with EAD. I am still hoping that my EAD will be approved before 19th.

With the existing 485 delays and uncertainities..this EAD that to renewal RFE is just rediculus.

I am sadened by this.

BCIS just killing us and nothing more !!

I might be too optimistice but you might get approvved before 19th. Maybe they had some inkling of that.

Now you don't have $1000 additional fee for H1B. So H1B fees should be less. $1500 doesn't make any sense.

What a contrast!!

I work for an non-desi company.

My company refused to file for my H1B extension saying I already have EAD and do not need H1B anymore.

I wanted to continue on H1B. I requested them for extension. I even offered that I would bear the expenses for my H1B extension but they did not oblige.

Sometimes I think desi companies are much better and flexible when it comes to GC. They atleast understand the importance and complexity in procuring a GC.

non-desi companies just layoff. They don't give a damn about one's immigration status. I know people who have been layed-off after their I140 is approved and before 6months on I485.
I think we are much better off when compared to such unfortunate ones.

Is your desi company AmeriSource by any chance?

Based on my friend's experience, I think you have a very good change to get your EAD before 11/19. My friend's EAD RFE case was approved in 35 days. I saw other RFE cases were approved very quick.

I totally sympathize with you concerning your ordeal. It could happen to any of us.

But I strongly object to you remarks "typical desi company".
If you really think all desi companies act like that you are wrong and pingpong's post confirms that all companies do that.

We applied thru a "typical desi company" and they have supported us all the way.

That is the problem here. A desi will never be happy with any desi.

I totally agree that BCIS is giving all of us lot of headaches but atleast be happy that a "typical desi company" did hire you and not lay you off when your previous project had ended.

Unfrtunaely, it happended to you.
They do not take much time for EAD approval. Hope, You will get it soon.

For 'dsatish' you will have to wait till Nov 19th.
You may get approved till Nov 19th. But if nothing
happens till or on 19th Nov its better to be ready with all documents and expenses for H1 filing ready so that
you will be in better shape.


I agree with z/OS V1.4.
Everye new day comes, changes our view of the world.
But due to this long process our views towards world
just do not change daily but we are having paradigm shift
in our life as we get invloved in more negative thinking.

Any desi and non-desi employer is same when it comes to
paying money when they are not getting any money in this
economy(I got laid off by non-desi during the process). But sometimes personal level relations may also have effect.

And BCIS also does mistakes. We got RFE for wife's name
BECAUSE BCIS made mistake in her name spelling
while sending receipt notices for EAD. And it took total 5 months.
So just file for EAD, AP extention like six month before expiry.
My one friend have not received AP after six months. And he
is not worried as he may not travel anytime soon.

Please use the advice as suitable to your situation.

A lot of people working with these so called desi companies should be very lucky for the way they are employed and having their GC processed. The so called normal companies give less attention to Immigration problems and try to avoid them as much as possible. When they have no other solution they scrutinize every little aspect of every application and they take their time also, especially if they do government business.
Example: My company was never in a hurry to change my status from H1-B to LC and GC. I spent the whole 7 year allowed before going to EAD. Back in late 2000 when I received RFE for the H-1B extension I needed to travel and had no visa approved. I had to pay the $1500.XX for PREMIUM processing myself so I could get it in 15 days. They did not even approve it in 15 days, but almost a month as they defined the clock running their way. In any case I did not travel. And then when it was time to file my I-485 my company refused and said they were discussing whether my job was "permanent". This took them SIX months. After this period, and when they could not find an AMERICAN CITIZEN to get/do my job, they said O.K. you have "permanent" position now. It took them another 2-3 months to collect the paperwork along with the immigration lawyer and finally send in the I-485! Compare with "desi" companies...

I am really sorry for your plight.

One question though, you mentioned your h1b expired in Feb 2003, and your ead expires nov 19, means you have been
working on EAD after Feb. Is it possible to go back to H1b then
after lapse of 10 months?

Sorry to hear that. Try to make one more trip to local office before Nov 19th, and see what happens.
